Judge David Kithil on Obamacare
WOW!! Lets hear it for the Judge! The article is in the Marble Falls , Texas newspaper. It was written by our former county judge, David Kithil. He voiced his opposition to HB 3200, and gave EXACT SPECIFICS, to include page and paragraph in the bill on why this Health Bill is BAD.
I called Thomas Edwards, Editor of the River Cities Tribune, to get legal permission to quote David Kithil's comments. He gave me that permission, so I can quote him. Here are excerpts from the article, giving EXACT pages and paragraphs in the bill and why it is so bad. You can forward this to all of your addressees. I think he hits everything right on the head and the opposition you may encounter cannot argue over these points:
JUDGE KITHIL: "I have reviewed selected sections of the bill and find it unbelievable that our Congress, led by Speaker Nancy Pelosi, could come up with a bill loaded with so many wrong-headed elements. We do need to reform the health insurance system in America in order to make coverage affordable and available to everyone. But, how many of us believe our federal government can manage a new program any better than the bankrupt Medicare program or the underfunded Social Security program? Both Republicans and Democrats are equally responsible for the financial mess of those two programs.
I am opposed to HB 3200 for a number of reasons. To start with, it is estimated that a federal bureaucracy of more than 150,000 new employees will be required to administer HB3200. That is an unacceptable expansion of a government that is already too intrusive in our lives. If we are going to hire 150,000 new employees, let's put them to work protecting our borders, fighting the massive drug problem and putting more law enforcement/firefighters out there."
NOW, here comes the good stuff: "Other problems I have with this bill include:
Page 50/section 152: The bill will provide insurance to all non-U.S. residents, even if they are here illegally.
Page 58 and 59: The government will have real-time access to an individual's bank account and will have the authority to make electronic fund transfers from those accounts.
Page 65/section 164: The plan will be subsidized (by the government) for all union members, union retirees and for community organizations (such as the Association of Community Organizations for Reform Now - ACORN).
Page 203/line 14-15: The tax imposed under this section will not be treated as a tax. (How could anybody in their right mind come up with that?)
Page 241 and 253: Doctors will all be paid the same regardless of specialty, and the government will set all doctors' fees.
Page 272. section 1145: Cancer hospital will ration care according to the patient's age.
Page 317 and 321: The government will impose a prohibition on hospital expansion; however, communities may petition for an exception.
Page 425, line 4-12: The government mandates advance-care planning consultations. Those on Social Security will be required to attend an "end-of-life planning" seminar every five years.
Page 429, line 13-25: The government will specify which doctors can write an end-of-life order."
HAD ENOUGH???? Judge Kithil then goes on: " Finally, it is specifically stated this bill will not apply to members of Congress. Members of Congress are already exempt from the Social Security system and have a well-funded private plan that covers their retirement needs. If they were on our Social Security plan, I believe they would find a very quick "fix" to make the plan financially sound for the future."

Why is this article not on the front page of every newspaper in America?
I know that there are thousands of cases like this in America's hospitals!

This letter appeared in the Jackson, Mississippi Clarion-Ledger dated August 23rd.

Dear Sirs:

"During last night's shift in the ER, I had the pleasure of evaluating a patient with a shiny new gold tooth, pierced tongue, multiple elaborate tattoos, a very expensive brand of tennis shoes and a new cellular telephone equipped with her favorite R&B ringtone.

Glancing over the chart, one could not help but notice her payer status: Medicaid.

She smokes more than one costly pack of cigarettes every day and, somehow, still has money to buy beer.

Now our president expects us to pay for this woman's health care? Our nation's health care crisis is not a shortage of quality hospitals, doctors or nurses,but a crisis of culture....a culture in which it is perfectly acceptable to spend money on pleasures and vices while refusing to take care of one's self or, heaven forbid, purchase health insurance. A culture that thinks, "I can do whatever I want to because someone else will always take care of me."

The reporter addressing the Harley rider says, 'Sir, this was the most gallant and
Brave thing I've seen a man do in my whole life.'The Harley rider replies, 'Why, it was nothing, really, the lion was behind bars. I
Just saw this little kid in danger and acted as I felt right.'

The reporter says, 'Well, I'll make sure this won't go unnoticed. I'm a journalist,
You know, and tomorrow's paper will have this story on the front page...
So, what do you do for a living and what political affiliation do you
Have?'

The biker replies, 'I'm a U.S. Marine and a Republican.' The journalist leaves.

The following morning the biker buys the paper to see if it indeed brings news of his
Actions, and reads, on the front page:

The entire Congress of the United States is corrupt

At least read this. Form your own opinion, even if you disagree with this issue, but at least read it. You and I owe that to our country

All I ask is that you consider the suggestion here.

The entire Congress of the United States is corrupt. And I mean both Houses and I mean both major parties.

I realize that a few Members of each House are trustworthy, but, as a group
they are absolutely the most corrupt bunch to ever disgrace our Nation.

In November of 2010 the entire House of Representatives will stand for re-election;
all 435 of them. One third of the Senate, a total of 33 of them, will also stand for re-election.
Vote every incumbent out.

And I mean every one of them. No matter their Party affiliation.
Let's start all over in the House of Representatives with 435 people who have absolutely no experience in running that body, with no political favors owed to anyone but their own constituents. Let's make them understand that they work for us.
They are answerable to us and they simply have to run that body with some common sense.

Two years later, in 2012, vote the next third of the incumbents in the Senate out.

We can do the same thing in 2014 and, by that time we will have put all new people in that body as well.

We, the People, have got to take this Country back and we HAVE to do it peacefully.

That's what the Framers of our Constitution envisioned.

I am also suggesting term limits on the NEW BUNCH -- 8 YEARS FOR REPRESENTATIVES two terms that’s all.
AND
12 YEARS [2 terms] FOR SENATORS.
NO EXCEPTIONS. THE LONGER THEY STAY IN OFFICE THE MORE POWER THEY GET AND THEY LOVE IT AND WILL DO ANYTHING TO GET RE-ELECTED.

WE HAVE TERM LIMITED THE PRESIDENT –
NOW LET'S TERM LIMIT THE LEGISLATORS.

And we do away with their Special Retirement system and their health program (they should have same health programs everyone else in America does). When they are through serving their country they go back to being private citizens. They should view their service as a privilege; after all it was designed to be a part time job to represent the voice of the people, NOT the special interest groups and those who can do favors for them.

If they don’t like this proposal then don’t run for office…

In a move certain to fuel the debate over Obama's qualifications for the presidency,
the group "Americans for Freedom of Information" has Released copies of President Obama's college transcripts from Occidental College . Released today, the transcript school indicates that Obama, under the name Barry Soetoro, received financial aid as foreign student from Indonesia as an undergraduate.
The transcript was released by Occidental College in compliance with a court order in a suit brought by the group in the Superior Court of California. The transcript shows that Obama
(Soetoro) applied for financial aid and was awarded a fellowship for foreign students from the
Fulbright Foundation Scholarship program. To qualify, for the scholarship, a student must claim foreign citizenship. This document would seem to provide the smoking gun that many of Obama's detractors have been seeking. Along with the evidence that he was first born in Kenya and there is no record of him ever applying for US citizenship, this is looking pretty grim. The news has created a firestorm at the White House as the release casts increasing doubt about Obama's legitimacy and qualification to serve as President. When reached for comment in London, where he has been in meetings with British Prime Minister Gordon Brown, Obama smiled but refused comment on the issue. Britain 's Daily Mail has also carried the story in a front-page article titled, "Obama Eligibility Questioned," leading some to speculate that the story may overshadow economic issues on Obama's first official visit to the U.K. In
a related matter, under growing pressure from several groups,
Justice Antonin Scalia announced that the Supreme Court agreed on Tuesday to hear
arguments concerning Obama's legal eligibility to serve as President in a case brought by
Leo Donofrio of New Jersey . This lawsuit claims Obama's dual citizenship disqualified him from serving as president. Donofrio's case is just one of 18 suits brought by citizens demanding proof of Obama's citizenship or qualification to serve as president.

Gary Kreep of the United States Justice Foundation has released the results of their investigation of Obama's campaign spending. This study estimates that Obama has spent upwards of $950,000 in campaign funds in the past year with eleven law firms in 12 states for legal resources to block disclosure of any of his personal records. Mr. Kreep indicated that the investigation is
still ongoing but that the final report will be provided to the U.S. attorney general, Eric Holder. Mr. Holder has refused to comment on the matter.

Thank you very much for inviting me.

I come to America with a mission. All is not well in the old world. There is a tremendous danger looming, and it is very difficult to be optimistic. We might be in the final stages of the Islamization of Europe. This not only is a clear and present danger to the future of Europe itself, it is a threat to America and the sheer survival of the West. The United States as the last bastion of Western civilization, facing an Islamic Europe.

First I will describe the situation on the ground in Europe . Then, I will say a few things about Islam. To close I will tell you about a meeting in Jerusalem ..

The Europe you know is changing.

You have probably seen the landmarks. But in all of these cities, sometimes a few blocks away from your tourist destination, there is another world. It is the world of the parallel society created by Muslim mass-migration.

All throughout Europe a new reality is rising: entire Muslim neighborhoods where very few indigenous people reside or are even seen. And if they are, they might regret it. This goes for the police as well. It's the world of head scarves, where women walk around in figureless tents, with baby strollers and a group of children. Their husbands, or slaveholders if you prefer, walk three steps ahead. With mosques on many street corners. The shops have signs you and I cannot read. You will be hard-pressed to find any economic activity. These are Muslim ghettos controlled by religious fanatics. These are Muslim neighborhoods, and they are mushrooming in every city across Europe . These are the building-blocks for territorial control of increasingly larger portions of Europe , street by street, neighborhood by neighborhood, city by city.

There are now thousands of mosques throughout Europe .. With larger congregations than there are in churches. And in every European city there are plans to build super-mosques that will dwarf every church in the region. Clearly, the signal is: we rule.

Many European cities are already one-quarter Muslim: just take Amsterdam , Marseille and Malmo in Sweden . In many cities the majority of the under-18 population is Muslim. Paris is now surrounded by a ring of Muslim neighborhoods. Mohammed is the most popular name among boys in many cities.

In some elementary schools in Amsterdam the farm can no longer be mentioned, because that would also mean mentioning the pig, and that would be an insult to Muslims.

Many state schools in Belgium and Denmark only serve halal food to all pupils. In once-tolerant Amsterdam gays are beaten up almost exclusively by Muslims. Non-Muslim women routinely hear 'whore, whore'. Satellite dishes are not pointed to local TV stations, but to stations in the country of origin.

In France school teachers are advised to avoid authors deemed offensive to Muslims, including Voltaire and Diderot; the same is increasingly true of Darwin . The history of the Holocaust can no longer be taught because of Muslim sensitivity.

In England sharia courts are now officially part of the British legal system. Many neighborhoods in France are no-go areas for women without head scarves. Last week a man almost died after being beaten up by Muslims in Brussels , because he was drinking during the Ramadan.

Jews are fleeing France in record numbers, on the run for the worst wave of anti-Semitism since World War II. French is now commonly spoken on the streets of Tel Aviv and Netanya , Israel .. I could go on forever with stories like this. Stories about Islamization.

A total of fifty-four million Muslims now live in Europe . San Diego University recently calculated that a staggering 25 percent of the population in Europe will be Muslim just 12 years from now. Bernhard Lewis has predicted a Muslim majority by the end of this century.

Now these are just numbers. And the numbers would not be threatening if the Muslim-immigrants had a strong desire to assimilate. But there are few signs of that. The Pew Research Center reported that half of French Muslims see their loyalty to Islam as greater than their loyalty to France . One-third of French Muslims do not object to suicide attacks. The British Centre for Social Cohesion reported that one-third of British Muslim students are in favor of a worldwide caliphate. Muslims demand what they call 'respect'. And this is how we give them respect. We have Muslim official state holidays.

The Christian-Democratic attorney general is willing to accept sharia in the Netherlands if there is a Muslim majority. We have cabinet members with passports from Morocco and Turkey .

Muslim demands are supported by unlawful behavior, ranging from petty crimes and random violence, for example against ambulance workers and bus drivers, to small-scale riots. Paris has seen its uprising in the low-income suburbs, the banlieus. I call the perpetrators 'settlers'. Because that is what they are. They do not come to integrate into our societies; they come to integrate our society into their Dar-al-Islam. Therefore, they are settlers.

Much of this street violence I mentioned is directed exclusively against non-Muslims, forcing many native people to leave their neighborhoods, their cities, their countries. Moreover, Muslims are now a swing vote not to be ignored.

The second thing you need to know is the importance of Mohammed the prophet. His behavior is an example to all Muslims and cannot be criticized. Now, if Mohammed had been a man of peace, let us say like Ghandi and Mother Theresa wrapped in one, there would be no problem. But Mohammed was a warlord, a mass murderer, a pedophile, and had several marriages - at the same time. Islamic tradition tells us how he fought in battles, how he had his enemies murdered and even had prisoners of war executed. Mohammed himself slaughtered the Jewish tribe of Banu Qurayza. If it is good for Islam, it is good. If it is bad for Islam, it is bad.

Let no one fool you about Islam being a religion. Sure, it has a god, and a here-after, and 72 virgins. But in its essence Islam is a political ideology. It is a system that lays down detailed rules for society and the life of every person. Islam wants to dictate every aspect of life. Islam means 'submission'. Islam is not compatible with freedom and democracy, because what it strives for is sharia. If you want to compare Islam to anything, compare it to communism or national-socialism, these are all totalitarian ideologies.

Now you know why Winston Churchill called Islam 'the most retrograde force in the world', and why he compared Mein Kampf to the Quran. The public has wholeheartedly accepted the Palestinian narrative, and sees Israel as the aggressor. I have lived in this country and visited it dozens of times. I support Israel . First, because it is the Jewish homeland after two thousand years of exile up to and including Auschwitz, second because it is a democracy, and third because Israel is our first line of defense.

This tiny country is situated on the fault line of jihad, frustrating Islam's territorial advance. Israel is facing the front lines of jihad, like Kashmir, Kosovo, the Philippines , Southern Thailand, Darfur in Sudan , Lebanon , and Aceh in Indonesia . Israel is simply in the way. The same way West-Berlin was during the Cold War.

The war against Israel is not a war against Israel . It is a war against the West. It is jihad. Israel is simply receiving the blows that are meant for all of us. If there would have been no Israel , Islamic imperialism would have found other venues to release its energy and its desire for conquest. Thanks to Israeli parents who send their children to the army and lay awake at night, parents in Europe and America can sleep well and dream, unaware of the dangers looming.

Many in Europe argue in favor of abandoning Israel in order to address the grievances of our Muslim minorities. But if Israel were, God forbid, to go down, it would not bring any solace to the West It would not mean our Muslim minorities would all of a sudden change their behavior, and accept our values. On the contrary, the end of Israel would give enormous encouragement to the forces of Islam. They would, and rightly so, see the demise of Israel as proof that the West is weak, and doomed. The end of Israel would not mean the end of our problems with Islam, but only the beginning. It would mean the start of the final battle for world domination. If they can get Israel , they can get everything. So-called journalists volunteer to label any and all critics of Islamization as a 'right-wing extremists' or 'racists'. In my country, the Netherlands , 60 percent of the population now sees the mass immigration of Muslims as the number one policy mistake since World War II. And another 60 percent sees Islam as the biggest threat. Yet there is a danger greater danger than terrorist attacks, the scenario of America as the last man standing. The lights may go out in Europe faster than you can imagine. An Islamic Europe means a Europe without freedom and democracy, an economic wasteland, an intellectual nightmare, and a loss of military might for America - as its allies will turn into enemies, enemies with atomic bombs. With an Islamic Europe, it would be up to America alone to preserve the heritage of Rome , Athens and Jerusalem .

Dear friends, liberty is the most precious of gifts. My generation never had to fight for this freedom, it was offered to us on a silver platter, by people who fought for it with their lives. All throughout Europe , American cemeteries remind us of the young boys who never made it home, and whose memory we cherish. My generation does not own this freedom; we are merely its custodians. We can only hand over this hard won liberty to Europe 's children in the same state in which it was offered to us. We cannot strike a deal with mullahs and imams. Future generations would never forgive us. We cannot squander our liberties. We simply do not have the right to do so.

We have to take the necessary action now to stop this Islamic stupidity from destroying the free world that we know.

In 1996, an unhappy consumer attacked the City Marshal of Lancaster, Missouri with a hammer.(1) The Marshal defended himself and later vented his adrenaline to the responding Sheriff stating, "I hope the son-of-a-bitch is dead." This led to the Marshal's conviction for involuntary manslaughter and a sentence of seven years in prison.(2) The story had a happy ending, but a story four years and tens of thousands of dollars in the making, and not a story the Marshal enjoyed very much. The Marshal might have avoided the worst part of the story had he not confused his right to remain silent with the right of free speech.

In the movie, Under Pressure, a woman tried to explain the stalking and implied threats of a neighbor. After a disorganized and unconvincing recitation of ambiguous events she lamely concludes, "I'm not a very good story teller." Most people tell stories badly. In the aftermath of self-defense there can be a giddy stream of consciousness statement which has more to do with the effects of adrenaline than reality. The basic legal advice is "DON'T."

The first question is, "What is a statement?" In a nation which counts exotic dancing as freedom of speech, a statement is also broadly construed. In 1996, the Missouri Supreme Court ruled that a suspect's refusal to uncross his legs during questioning could be taken as a statement when later charged with murder.(3) In a separate death penalty case, the court found that the defendant had purchased a used car which sported the bumper sticker, "I'm the person your mother warned you about." At trial the prosecution argued that the fact he did not remove this bumper sticker revealed something about his character. The Missouri Supreme Court ruled that it was perfectly acceptable for the state to kill this man, in part, because of his failure to remove the bumpersticker.(4) One can imagine the effect of bumper stickers bought in jest such as, "Keep Honking, I'm Reloading." If this case does not also inspire a re-evaluation of one's T-shirt collection, nothing will.

There is also the problem of nicknames. As of this writing, a rapper who rejoices in the stage name "C-Murder" is on trial for murder. If I were asked to defend a man named "Murder" or any variation thereof, I would charge more. Massad Ayoob testified in favor of a police officer who had killed a felon nicknamed "Snake." Captain Ayoob slipped the nickname into his testimony which seems to have had an effect on the jury.

Written statement, a VERY BAD idea!


There is a cynical defense attorney saying: "Anything you say will be misquoted and used against you." In the movie, My Cousin Vinnie, two, unfortunate Yankees are suspected of murder and during questioning are accused of shooting a clerk. One incredulously asked, "I shot the clerk?" This is taken down and read in court as a confession. Theater audiences laughed, defense attorneys smiled and nodded. There have even been cases where comments by other persons have been attributed to the defendant, and used against him; complete silence is the only bulwark against these mistakes.

The first statement is the 911 call. These calls are recorded and if the call sounds bad for the defendant, it will be played over and over again at trial. In one case, a man cocked his double-action revolver and went after a person who was shooting out windows. When he caught up with the threat he extended his revolver and in the process tripped the light single action trigger pull; arguably an accidental discharge. His 911 call records him saying that he thought he had just shot someone. The 911 operator, trained to keep him on the line and keep him talking, asked why he thought he had shot someone. The man replied, "Lady, I think I'm a pretty good shot." This callous-sounding statement took accident off the table and the man had to live or die with a self-defense case. This all important introduction to law enforcement must be planned in advance.

The first words out of the caller's mouth should be the location of the incident. If the battery then dies, or the minutes run out, or some other technological catastrophe occurs the authorities will know that something of interest is at that location, and the caller's cell phone records can prove that he or she made the call. The next statement is the caller's name. The core of the 911 call consists of three sentences:

"He tried to kill me."
"I was never so scared in my life."
"Send an ambulance."(5)

The first sentence serves to introduce the roles of the parties, the caller is the victim, the other person the attacker. Being in reasonable fear of life or limb is a prerequisite to acting in self-defense. The phrase "I was never so scared..." is to preclude the prosecutor from claiming that the citizen never said he was scared "until he talked to a lawyer."(6) The phrase "Send an ambulance" says that the caller does not want anyone to die.

When the police arrive, they will want a more elaborate statement; this should consist only of:

1. He attacked me.
2. I will sign a complaint.
3. There is the evidence.
4. I WANT A LAWYER.
Good Advice.


This restates part of the 911 call and points out critical evidence. One cannot expect the "CSI" team to be called out to pick up every fiber and hair. If a real forensic team routinely conducted the investigations shown on television, its budget would last about a week.

The demand for a lawyer is both the best thing one can do, and a damaging statement. Anyone who is questioned by police has the right to a lawyer; this includes victims. The problem is that the police, and potential jurors, take a demand for a lawyer as evidence of something to hide. To compound the problem, the victim's decision to remain silent and demand for a lawyer can be used again him or her in court. In the criminal system, one does not have rights, until arrested; it doesn't have to make sense, it's just the law. It is a left-handed fortune that people who act in self-defense are routinely arrested. It may be called something else such as "detained" or given the "Alice in Wonderland" explanation "You're being handcuffed for your own protection." Whenever a person is not allowed to leave, he is placed under arrest regardless of descriptive terms. If one is arrested, generations of TV shows advise us to remain silent.

If the circumstances are ambivalent, simply state a fear of being sued, and demand a lawyer to protect against frivolous litigation. Bernard Goetz was acquitted of criminal charges in the shooting of four thugs on the subway, but was sued for $43 million and lost. Police are frequently sued by criminals and the explanation is likely to ring a bell.

Self-defense cases bring out the curious, the media in the forefront. Comments to friends will be confused and used against you, comments to family will be mistaken and used against you. Both family and friends can be subpoenaed and forced to testify against you. Comments to the media will be sensationalized and this is never good. The New York City prosecutor's office had determined not to charge Bernard Goetz, until he made unwise remarks to the news media. At some point a statement must be made. The impression is that the earlier a statement is made, the more reliable it is. In reality, the earlier a statement is made, the less reliable it is. The effects of stress will confuse the statement and even cause temporary amnesia. Inaccuracies in the initial statement will convince authorities that the survivor is both a liar and a murderer. A lawyer must be immediately engaged to organize the statement.

A lawyer is a professional storyteller. He will not tell the client how to lie, he will tell him how to tell the truth, a more complicated process than most imagine. The statement must contain facts which track the elements of self-defense. In the case of defense of home or defense of other persons, there may be other elements as well. Knowledge of the assailant's reputation for violence would certainly be relevant. The most important element to include is fear. A police statement is no place for macho posturing. One cannot use violence against another person unless in fear of life or limb. The survivor must go over every detail of why he or she was terrified, weak-kneed, pants-pissing afraid. If one does foul one's pants, a not uncommon event, make sure that goes into the statement. No matter how ineffective a storyteller the survivor might be, the jury is sure to believe that.

Both here and in general I hear from people that are happy that Obama is our new president

Both here and in general I hear from people that are happy that Obama is our new president, yet it doesn't really seem that they agree with his stated positions or voting record. These people say they hope things will 'get better now' that he is president or something similar, but never really elaborate. I am trying (struggling) to understand.

Keeping it related to this forum - in another thread some members expressed being happy that Obama is president. Obviously all that are on this forum cherish their 2nd amendment rights and from his statements, recent appointments, and voting record Obama does not. Why would that person be happy he was elected? Is there something about him, or something you think he will accomplish that is more important to you than your 2nd amendment rights and you would give them up for?

Please understand I have nothing against anyone that is happy Obama is president, I am just trying to understand why - particularly when these same people do not seem to agree with his positions. Is it not one of our duties to our country to make sure we elect those that will uphold the constitution and agree with our values?

I'm trying to understand why people elect those that do not agree with their own positions. I have been for some time as I am from the Northeast US where nearly everyone I know complains about the state of affairs, yet somehow they keep electing the same career politicians over and over even when there are great alternatives.

As posted in comments on Greta Van Susteren of Fox News article referencing the MOVEON ad about Sarah Palin.

The last 45 of my 66 years I've spent in a commercial fishing town in
Alaska . I understand Alaska politics but never understood national politics well until this last
year. Here's the breaking point: Neither side of the Palin controversy gets it. It's not about
persona, style, rhetoric, it's about doing things. Even Palin supporters never mention the things that I'm
about to mention here.

1- Democrats forget when Palin was the Darling of the Democrats, because as soon
as Palin took the Governor's office away from a fellow Republican and tough SOB, Frank Murkowski, she tore into the
Republican's "Corrupt Bastards Club" (CBC) and sent them packing. Many of them are now residing in State
housing and wearing orange jump suits The Democrats reacted by skipping around the yard, throwing confetti and singing,
"la la la la" (well, you know how they are). Name another governor in this country that has ever done anything similar.

2- Now with the CBC gone, there were fewer Alaskan politicians to protect the
huge, giant oil companies here. So she constructed and
enacted a new system of splitting the oil profits called "ACES." Exxon (the biggest corporation in the
world) protested and Sarah told them, "don't let the door hit you in the stern on your way out." They
stayed, and Alaska residents went from being merely wealthy to being filthy rich... Of course, the other huge international
oil companies meekly fell in line.. Again, give me the name of any other governor in the country that has done anything similar.

3- The other thing she did when she walked into the governor's office is
she got the list of State requests for federal funding for
projects, known as "pork.." She went through the list, took 85% of them and placed them in the
"when-hell-freezes-over" stack. She let locals know that if we need something built, we'll pay for it
ourselves. Maybe she figured she could use the money she got
from selling the previous governor's jet because it was extravagant. Maybe she could use the money she saved by
dismissing the governor's cook (remarking that she could cook for her own family), giving back the State vehicle
issued to her, maintaining that she already had a car, and dismissing her State provided security force (never
mentioning - I imagine - that she's packing heat herself). I'm still waiting to hear the names of those other governors.

4- Now, even with her much-ridiculed "gosh and golly" mannerism, she
also managed to put together a totally new approach to getting a natural gas pipeline built which will be the
biggest private construction project in the history of North America. No one else could do it although they tried. If
that doesn't impress you, then you're trying too hard to be unimpressed while watching her do things like
this while baking up a batch of brownies with her other hand..

5- For 30 years, Exxon held a lease to do exploratory drilling at a place called
Point Thompson. They made excuses the entire time why they couldn't start drilling. In truth they were holding it
like an investment. No governor for 30 years could make them get started... This summer, she told them she was revoking
their lease and kicking them out. They protested and threatened court action. She shrugged and reminded them that
>she knew the way to the court house. Alaska won again.

6- President Obama,wants the nation to be on 25% renewable resources for
electricity by 2025. Sarah went to the legislature and submitted her plan for Alaska to be at 50% renewables
by 2025. We are already at 25%. I can give you more specifics about things done, as opposed to style and
persona. Everybody wants to be cool, sound cool, look cool.
But that's just a cover-up. I'm still waiting to hear from liberals the names of other governors who can
match what mine has done in two and a half years. I won't be holding my breath.

By the way, she was content to return to AK after the national election and go
to work, but the haters wouldn't let her. Now these adolescent screechers are obviously not scuba divers. And no
one ever told them what happens when you continually jab and pester a barracuda. Without warning, it will spin around and
tear your face off. Shoulda known better.

You have just read the truth about Sarah Palin that sends the media, along with the
democrat party, into a wild uncontrolled frenzy to discredit her. I guess they are only interested in skirt chasers,
dishonesty, immoral people, liars, womanizers, murderers, and bitter ex-presidents' wives...

So "You go, Girl." I only wish the men in Washington had your guts, determination, honesty, and morals.

I rest my case.

Only FOOLS listen to the biased media.

Ted Nugent, rock star and avid bow hunter from Michigan , was being interviewed by a French journalist, (an animal rights activist). The discussion came around to deer hunting.

The journalist asked, "What do you think is the last thought in the head of a deer before you shoot him? Is it, 'Are you my friend?' or is it 'Are you the one who killed my brother?'"

Nugent replied, "Deer aren't capable of that kind of thinking. All they care about is, what am I going to eat next, who am I going to screw next, and can I run fast enough to get away. They are very much like the French."

Have I got a story for you guys! King [salmon] season is over, and since I had a day off before Silvers start, I thought I would go for a walk! This occurred at 11:16 am this morning (Sunday), just 2/10 of a mile from my house, on our road, while walking my dogs (trying to get in shape for hunting season ironically).
For the record, this is in a residential area- not back in the woods, no bow hunting, no stealth occurring.

I heard a twig snap, and looked back. In full on charge was a huge brownie, ears back, head low and motoring full speed! It came with zero warning; no woof, no popping of the teeth, no standing up, nothing like what you think or see on TV!
It charged from less than 20 yards and was on me in about one-second! Totally surreal. I just started shooting in the general direction, and praise God that my second shot (or was it my third?) rolled him at 5 feet and he skidded to a stop 10 feet beyond where I was shooting from.
I actually sidestepped him and fell over backwards on the last shot, and his momentum carried him to a stop past where I fired my first shot!

It was a prehistoric old boar- no teeth, no fat. It weighed between 900-1000 Lbs and took five men to drag it onto a tilt-bed trailer! Big bear- its paw measured out at about a 9 1/2 footer!

Never ever-thought "it" would happen to me! It's always some other schmuck, right? Well, no bull- I am still high on adrenaline with my gut in a knot. Feels like I did 10 thousand crunches without stopping! I almost puked for an hour after and had the burps. I couldn't even stand up as the troopers conducted their investigation! The experience totally wiped me out. I can̢۪t even put that feeling into words. By far the most emotion I have ever felt at once!

No doubt that God was with me as I brought my Ruger .454 Casull (and some "hot" 350 grain solids) just for the heck of it, and managed to draw and snap shoot (pointed, never even aimed) from the hip! Total lucky shot!

All I can say is praise God for my safety and for choosing to leave the wife and kids at home on this walk! Got a charter tomorrow, so gonna try to get some sleep now!

It was widely reported this week that the Maersk Alabama -- the American-flagged ship that was captured by pirates last April -- came under attack for the second time in seven months as Somali pirates once again tried to hijack the ship early Wednesday morning off the Somalia coast.

In the April attack, pirates were successful in boarding the ship and taking captain Richard Phillips hostage, holding him at gunpoint in a lifeboat for five harrowing days. A Navy SEAL team was eventually able to free Phillips, killing three pirates and capturing a fourth in the process.

This time around, when the sea-thugs approached the ship and fired on it, they were met with return gunfire from the ship's security detail, and were repelled in their attack.

While the shipping industry has yet to endorse the use of armed security, as the number of violent attacks continues to increase, a few ship owners and operators have chosen common sense and a right to self-defense over appeasement and political correctness by hiring their own armed security personnel.

Piracy off the Somali coast continues to rise, with the pirates seeming to become more sophisticated and bold with every passing day. And, unfortunately, the pirates' success and boldness are bolstered by well-meaning but futile attempts to "negotiate" with them. On Tuesday, pirates released 36 crewmembers from a Spanish tuna trawler after holding them hostage for more than six weeks. The pirates reportedly received a $3.3 million ransom.

"Somali pirates understand one thing and only one thing, and that's force," said Captain Joseph Murphy, a maritime security professor at the Massachusetts Maritime Academy and the father of a sailor who was on the Maersk Alabama during the first pirate attack in April. "They analyze risk very carefully, and when the risk is too high they are going to step back. They are not going to jeopardize themselves."

Vice Admiral Bill Gortney of the U.S. Naval Forces Central Command said in a statement that the Maersk Alabama had followed the maritime industry's "best practices" by having a security team on board the ship. "This is a great example of how merchant mariners can take proactive action to prevent being attacked and why we recommend that ships follow industry best practices if they're in high-risk areas," said Gortney.

However, when it comes to armed self-defense on the high seas, not all agree. Roger Middleton, a piracy expert at the London-based think tank Chatham House, said the international maritime community was still "solidly against" armed guards aboard vessels at sea, but that American ships have taken a different line than the rest of the international community.

"Shipping companies are still pretty much overwhelmingly opposed to the idea of armed guards," Middleton said. "Lots of private security companies employ people who don't have maritime experience. Also, there's the idea that it's the responsibility of states and navies to provide security. I would think it's a step backward if we start privatizing security of the shipping trade."

Clearly, merchant ships in known hostile waters need guns to fight pirates and repel their attacks. No general would think to send troops into a combat zone unarmed. In a hostile environment, unarmed ships, like unarmed people, are vulnerable. You know that, and so do the pirates. Criminals and predators of all types prefer an easy target.

The parallel between criminal and victim on the sea, or in your community is obvious. It is not practical to depend on the U.S. Navy to protect all merchant ships, in every circumstance, any more than it is practical to rely on the police to protect you, your home, and your family 24 hours a day. Navy ships and local police cannot be everywhere all of the time, and they generally arrive at "the scene of the crime" after the crime has already taken place.

It is far better to afford merchant ships and law-abiding citizens the opportunity to defend themselves. The best way to eliminate crime is to eliminate criminals, and to respect the innate right of self-defense.

The Board of Aldermen of the City of St. Robert recently passed an ordinance banning the discharge of any “projectile device" within the city limits.
Unfortunately, this ordinance makes no exemption for the use of a firearm in self-defense, even in one's own home.
Please contact your city aldermen and let them know you want the act of self-defense within the city limits to be protected and exempted in this ordinance!
An ordinance amending the St. Robert City Code by Amending Section 200.250 (Discharging air guns and other projectile devices) of the city code
Be it ordained by the Board of Aldermen of the city of St. Robert, Missouri, As Follows:
Section 1. That the Board of Aldermen of the City of St. Robert have determined that there is a need to amend the City Code.
Section 2. That Section 200.250 is hereby amended as stated in Exhibit A, which is attached hereto and fully incorporated herein.
Section. 3. This Ordinance shall be in full force and effect from and after its passage and approval.
Section 200.250: Discharging air gun and other projectile device
1. Any person within the limits of this City who shall discharge any BB gun, spring gun or air gun or shall shoot any pebble, bullet, slug, arrow or other hard substance by means of a sling, crossbow, rubber band or bow or any other means shall be deemed guilty of an ordinance violation.
2. This Section shall not apply to any person engaged in the lawful pursuit of game or hunting in compliance with Section 200.240 of the City Code and all Missouri state statutes and regulations.
It is very important to contact your city aldermen and let them know you want self-defense exempted in this discharge ban.

Practice Carrying Concealed: An Interesting Perspective

This article by David Woodbury is aimed toward those who have not yet reached a point of confidence to carry concealed even though they have a permit to do so. It is better to build up one's confidence even if one has to practice carrying a concealed mock weapon (if legally permitted in your area). No need for emails about how temporarily carrying a mock or empty weapon is useless. Never carrying at all due to lack of confidence in one's abilities is permanently useless.

It bears repeating: Practice handling and shooting your gun before you need to use it. But if you're going to carry concealed, practice CARRYING before you actually do it.

Always Deciding to carry concealed presents some interesting and important mental challenges. Besides always staying in practice, so you are always as safe as you can be in a crisis, there are many more demands on you, all of them preceded by the word "always". (And there are scores of other demands preceded by "never", but those are the ones we hear all the time.)

ALWAYS know where your gun is, both when it's on your body and when it's not.
ALWAYS know whether it's loaded, when it's on your body and when it's not.
ALWAYS know whether it's locked (or whether the safety is on, depending what type of hardware you're packing).
ALWAYS know how you can sit, stand, walk, and run so it won't bulge or "print" on you.
ALWAYS know how close you are to other people and whether there might be someone close by who would give you a spontaneous hug or a friendly pat in the wrong place.
ALWAYS, always, always.

These are things -- and I could add many more -- that you cannot forget, even for a moment.

Permit Today, Pack Tomorrow. Yes, you can get a concealed carry permit and then immediately begin carrying when you've never, or seldom, done it before. But to do so requires a level of mental discipline that most of us don't possess the moment we start. You will make mistakes if you do it that way. Start packing without the mental discipline, and you will fail the ALWAYS test above. So I'm here to offer a handful of suggestions.

A. Before you ever carry a loaded firearm, carry a single cartridge
Do it before you ever get a permit. Start with one, and see whether you can say positively that you are aware every moment where it is. Where is it while you're in the shower? While you're at work? While you're at the Post Office or in church? Where is it when the clothes you just wore are in the washing machine? If you slip up and someone finds out that you have it, so what? You can explain it any number of ways, and you don't need a permit.

Then carry six at once, or whatever number would fully reload your magazine or your cylinder. This may be more important a skill than you think, because even though the idea of carrying a lone bullet is to make you accountable for carrying a firearm later, you'll also want to figure out how to carry extra ammo once you do start to go around armed.

(I've found that the little Tyvek sleeve the bank gives me for my credit card holds six round of .38 or .357 neat and flat.)

B. Carry a toy gun
In the side-street toy shops you can still buy a near-life-size plastic revolver or a squirt gun shaped like a semi-automatic. Try carrying one of these concealed for a few weeks. If it's longer than your real gun, cut it down to match. Or, if it's just too weird to carry plastic, cut a notch out of a bush or small tree (or carve a block of wood) to something vaguely resembling the dimensions of the gun you may one day carry, and carry the piece of wood for a few weeks first. If someone finds out you have it on you, again, you can explain it any number of ways.

If it's not your intention to carry a concealed firearm but, say, a tactical knife for personal protection, then modify this suggestion to something vaguely resembling the size and weight of that equipment.

C. Carry an empty gun
Once you are comfortable with the feel of carrying and the discipline needed to keep it concealed and safe, there's still a quantum mental shift from concealing a piece of harmless metal to concealing something that is instantly deadly. Carrying empty gives you the complete feel, but not the feeling. Once you start carrying for real, you're making two monumental adjustments: You need to get past the self-conscious stage with the real hardware, and you need to reckon the gravity of the choices you can now make. Notice I didn't say you have to do both at the same time.

To get past the self-conscious stage, carry empty but on alternate days for a week or so. Do it one day, then think it over and adjust your habits the next day. Then carry empty for a week, maybe with the ammo in a pocket somewhere.

The quantum mental shift doesn't come with the permit. It takes weeks of training in the military. Putting on the uniform the first day doesn't do it. It's accepting that every day, because of the choices someone else makes, you're ready to take a life. (And, as has been said in these pages so many other ways, if you're not ready to take a life, then you shouldn't be packing.)

The Consequences: Even though I'm a Registered Maine Guide, even though I've hunted for 40 years, even though I'm an Army veteran, even though I've been a security manager (unarmed), even though I have long owned firearms of several types, I didn't make the transition instantaneously once I started packing a few years ago. I was accustomed to open carry as in hunting: slipping the safety off and on as I moved about, unloading in the open before re-entering a vehicle, and so on. When I'm armed for hunting, it's right out in front of me where I'm acutely aware of it and open to the world at the same time. And no one where I live gives any thought to seeing someone alongside the road lugging a shotgun or rifle.

But I didn't start out doing A, B, or C. Why? I just thought I was already so handy and safe with firearms that packing heat would be natural. And because of that assumption, here are a few things that happened to me once I began carrying daily.

1. I forgot that the gun was on me. I had eventually found a way to carry that was so comfortable I didn't have the slightest discomfort to remind me it was there. The day it happened, I'm sure no one saw anything, but before I was sure I had to think about everywhere I'd been for the couple of hours that I had forgotten about it.

2. I dropped it in public. The way I carried at the time, in an unbelted holster tucked in my pants at the small of my back, it left me vulnerable to slippage when I exited a vehicle. It had shifted in a way that, even though I still felt it, I didn't realize how loose it was. Again, no one saw.

3. I left it in a desk drawer that others had access to, loaded and ready. This was really stupid, but I had to get it off me quickly and then go meet some people in another room for a time. I should have simply continued to carry it. The one person who'd have been most likely to find it never mentioned it, and would have been fine with it even if she had found it. But I wish I'd never subjected her to the awkwardness of the possibility.

4. I forgot where it was in the house after I had gone to bed. After I dressed the next morning and went to get it, it wasn't where I expected to find it. I scrambled mentally to remember what had interfered with my routine the night before, and then I found it.

5. While it was on me, I forgot whether it was locked. I carry a Rossi knock-off of a S&W .38 Chief's Special. It has a neat little screw in the back of the hammer that you set or release with a custom hex key. I was carrying, but sort of remembered that I had locked it the day before when I went to bed. (It's not the night security piece.) I sort of remembered that I had unlocked it the next morning, but in the middle of the day in question, in the company of others who I couldn't excuse myself from for at least another hour, I wanted nothing more than to check it. On the Rossi, if you can just touch the base of the hammer with a fingertip, you can tell whether it's locked.

6. The very first day I started carrying, my employer sent me on an overnight trip. Alone in a motel room, I debated keeping it loaded and ready. I truly wondered, in fact, whether I might be a sleepwalker in an unfamiliar setting and not know it, or whether I could otherwise harm myself or others with it while not fully awake. I unloaded it to be more certain. The mental discipline for everyone here is to be sure what kind of sleeper you are before dropping off too soundly next to a loaded gun. Are you someone who does anything at all in your sleep that you've not been fully aware of while you're doing it?

These are examples of common challenges in mental discipline. But there was one thing that was probably harder to get used to than overcoming any of these six glitches. It was simply the astonishing realization at first that I was armed and potentially deadly. Not as deadly as driving distracted at 70 mph. Not as deadly as when leading people into the wilderness in November where someone in your party can decide to wander off and get lost, leaving you to find him before he freezes. But deadly if someone else chooses that I must be.

Carrying concealed, it took me a long time to get over the fact that I could drop a human being in two or three seconds, power I had never had before. If I were highly skilled in the manual martial arts I might have that feeling, but I also would have spent years getting used to it as my skills improved. When your skill is with a firearm, you're harmless one moment, deadly the next.

If you own a gun for self-defense, practice handling and shooting before the day when someone decides for you that it will matter. But if you're going to carry, practice carrying before the day when you decide for yourself to go about armed!

Senate health committee voted 12-11 in favor of a two-page amendment

On Tuesday, the Senate health committee voted 12-11 in favor of a two-page amendment
courtesy of Republican Tom Coburn that would require all Members and their staffs to enroll
in any new government-run health plan.

Suppose that every day, ten men go out for beer, and the bill for all ten comes to $100.
If they paid their bill the way we pay our taxes, it would go something like this:

The first four men (the poorest) would pay nothing.
The fifth would pay $1.
The sixth would pay $3.
The seventh would pay $7.
The eighth would pay $12.
The ninth would pay $18.
The tenth man (the richest) would pay $59.

So, that’s what they decided to do.
The ten men drank in the bar every day and seemed quite happy with the arrangement, until one day, the owner threw them a curve.
‘Since you are all such good customers, he said, ‘I’m going to reduce the cost of your daily beer by $20. Drinks for the ten now cost just $80.

The group still wanted to pay their bill the way we pay our taxes, so the first four men were unaffected. They would still drink for free.
But what about the other six men – the paying customers? How could they divide the $20 windfall so that everyone would get his ‘fair share?’
They realized that $20 divided by six is $3.33. But if they subtracted that from everybody’s share, then the fifth man and the sixth man would each end up being paid to drink his beer.
So, the bar owner suggested that it would be fair to reduce each man’s bill by roughly the same amount, and he proceeded to work out the amounts each should pay.
And so: The fifth man, like the first four, now paid nothing (100% savings)
The sixth now paid $2 instead of $3 (33%savings).
The seventh now pay $5 instead of $7 (28%savings).
The eighth now paid $9 instead of $12 (25% savings).
The ninth now paid $14 instead of $18 (22% savings).
The tenth now paid $49 instead of $59 (16% savings).

Each of the six was better off than before. And the first four continued to drink for free.
But once outside the restaurant the men began to compare their savings.
‘I only got a dollar out of the $20,’ declared the sixth man. He pointed to the tenth man, ‘but he got $10!’
‘Yeah, that’s right,’ exclaimed the fifth man. ‘I only saved a dollar, too. It’s unfair that he got ten times more than I!’
‘That’s true!!’ shouted the seventh man. ‘Why should he get $10 back when I got only two? The wealthy get all the breaks!’
‘Wait a minute,’ yelled the first four men in unison. ‘We didn’t get anything at all. The system exploits the poor!’
The nine men surrounded the tenth and beat him up.
The next night the tenth man didn’t show up for drinks, so the nine sat down and had beers without him.
But when it came time to pay the bill, they discovered something important. They didn’t have enough money between all of them for even half of the bill!

And that, boys and girls, journalists and college professors, is how our tax system works.
The people who pay the highest taxes get the most benefit from a tax reduction.
Tax them too much, attack them for being wealthy, and they just may not show up anymore.
In fact, they might start drinking overseas where the atmosphere is somewhat friendlier.

Thought you might be interested in this information from the White House. This isn't a
rumor; this is a fact. We have a friend at church who is a very talented artist. For several years she, among many others, has painted ornaments to be hung on the various White House
Christmas trees. The White House sends out an invitation to send an ornament and informs the artists of the theme for the year.

She got her letter from the White House recently. It said that they would not be called
Christmas trees this year. They will be called Holiday trees. And, to please not send any ornaments painted with a religious theme. She was very upset at this development and
sent back a reply telling them that she painted the ornaments for Christmas trees and would not be sending any for display that left Christ out of Christmas.

Just thought you should know what the new residents in the White House plan for the future of
America . If you missed his statement that "we do not consider ourselves a Christian Nation" this should confirm that he plans to take us away from our religious foundation as quickly as possible.

A new study raises fresh concerns about Zetia and its cousin, Vytorin — drugs still taken by millions of Americans to lower cholesterol, despite questions raised last year about how well they work.

In the study, Zetia failed to shrink buildups in artery walls while a rival drug, Niaspan, did so significantly. Zetia users also suffered more heart attacks and other problems although the numbers of these events were too small to draw firm conclusions.

Zetia "has been on the market for about seven years and we still haven't proven that it improves clinical outcomes," said Dr. Roger Blumenthal, preventive cardiology chief at Johns Hopkins University. The new results will be "very influential" in getting more doctors to turn to Niaspan, he said.

He wrote an editorial accompanying the results, which were presented Sunday at an American Heart Association conference and published on the Internet by the New England Journal of Medicine.

The study is too limited to warrant changing practice, heart experts said. Patients also should not stop taking any heart medicine without checking with their doctors, they warn.

Statins such as Lipitor and Crestor have long been used to lower LDL, or bad cholesterol, and are known to cut the risk of heart problems. Nevertheless, many statin users still suffer heart attacks, so doctors have been testing adding a second medicine to further lower risk.

One they are trying is Niaspan, a slow-release version of niacin, a type of B vitamin that raises HDL, or good cholesterol. Another is Zetia, which lowers bad cholesterol in a different way than statins do, by blocking its absorption in the gut.

Vytorin is a pill that combines Zetia with a statin. Both are sold by Merck & Co. of Whitehouse Station, N.J. Niaspan is made by North Chicago, Ill.-based Abbott Laboratories. All three of these drugs cost between $3 and $4 a day, though niacin has been sold as a cheap generic for decades. The heart association advises consumers against using over-the-counter vitamin versions in place of prescriptions, though, because they may have purity and potency issues and other risks.

The new study was sponsored by Abbott, and several study leaders have been paid speakers or consultants to the company or to rival drugmakers.

Researchers enrolled 363 people with heart disease or a high risk for it who had been taking statins for six years on average. Many were from Walter Reed Army Medical Center, where study leader Dr. Allen Taylor formerly worked.

Half were given Niaspan and the rest, Zetia. Researchers stopped the study in June, after 208 participants had been on the medicines for 14 months, because one group was faring much better than the other.

Ultrasound images of neck arteries showed that Niaspan shrank buildups by about 2 percent, while Zetia had no effect on this even though it lowered bad cholesterol as expected.

There were two heart attacks, heart-related deaths or other heart-related problems in the 160 people given Niaspan, and nine among the 165 on Zetia.

"It should be better for the arteries and it wasn't," Taylor said of Zetia. "The drug wasn't operating as you otherwise would expect it to," raising concern that its effects are not fully understood, he said.

Merck's research chief, Peter Kim, said the study and number of heart attacks and other problems are too small to be conclusive. More than 25,000 people are in studies testing Zetia now, and independent monitors have found no problems that would lead them to stop the trials.

"We stand behind the safety of this drug," he said.

Kenneth Frazier, Merck's president of global human health, said: "The question is, how important is the study?" Shrinking plaque is no guarantee that heart attacks will be prevented, and not all studies have found a correlation, he said.

However, the difference in plaque that Niaspan made in this study "is precisely the same as the difference" that earlier studies found from statins, which are now known to save lives, said Dr. James Stein of the University of Wisconsin-Madison. He is a leading researcher on imaging artery buildups and in the past consulted for Schering-Plough Corp., which used to market Vytorin with Merck.

Dr. Sidney Smith, a former heart association president from the University of North Carolina at Chapel Hill, said that for people with newly diagnosed cholesterol problems, "the foundation is still statins." The new study "affirms the benefits of niacin" and makes it the next drug to add if people need more help, he said.

Dr. Anthony DeMaria, a past president of the American College of Cardiology from the University of California at San Diego, said the study "doesn't quite put the nail in the coffin" for Zetia, but pushes it way down on the list of things to try.

Last year, a large study found that the combo pill Vytorin was no more effective than Zocor alone, a statin now available as a cheap generic. In August, Merck and Schering-Plough agreed to pay $41.5 million to settle lawsuits claiming they delayed unfavorable study results on the drugs because they would hurt sales.

The drugs remain blockbusters: Vytorin had nearly $2 billion in sales in the United States in 2008; Zetia, more than $1.5 billion, according to IMS Health, a health care information and consulting company.

However, that's down substantially: Zetia prescriptions fell 22 percent, from nearly 16.5 million in 2007 to less than 13 million in 2008. Vytorin fell 24 percent in that time, from about 22 million in 2007 to 16.5 million in 2008. Vytorin sales were down another 36 percent in the first half of this year.

Niaspan has been gaining but lags far behind — 5.8 million prescriptions in 2008, up 11 percent from 2007.

Its main drawback is a prickly hot sensation called flushing that many people find intolerable. The extended-release version is supposed to minimize this, but a third of study participants still suffered it. The problem tends to go away with longer use and can be blunted by taking the medicine with aspirin, at bedtime, or with a low-fat snack, doctors say.
