Dear Mr. Obama:
Were those Muslims that were in America when the Pilgrims first landed? Funny, I thought they were Native American Indians.
Were those Muslims that celebrated the first Thanksgiving
day? Sorry again, those were Pilgrims and Native American Indians.
Can you show me one Muslim signature on the United States Constitution?
Declaration of Independence ?
Bill of Rights?
Didn't think so.
Did Muslims fight for this country's freedom from England ? No.
Did Muslims fight during the Civil War to free the slaves in America ? No, they did
not. In fact, Muslims to this day are still the largest traffickers in human
slavery. Your own half brother, a devout Muslim, still advocates slavery himself, even though Muslims of Arabic descent refer to black Muslims as "pug nosed slaves." Says a lot of what the Muslim world really thinks of your family's "rich Islamic heritage," doesn't it Mr. Obama?
Where were Muslims during the Civil Rights era of this country? Not present.
There are no pictures or media accounts of Muslims walking side by side with Martin Luther King, Jr. or helping to advance the cause of Civil Rights.
Where were Muslims during this country's Woman's Suffrage era? Again, not present. In fact, devout Muslims demand that women are subservient to men in the Islamic culture. So much so, that often they are beaten for not wearing the 'hajib' or for talking to a man who is not a direct family member or their husband. Yep, the Muslims are all for women's rights, aren't they?
Where were Muslims during World War II? They were aligned with Adolf Hitler. The Muslim grand mufti himself met with Adolf Hitler, reviewed the troops and accepted support from the Nazi's in killing Jews.
Finally, Mr. Obama, where were Muslims on Sept. 11th, 2001? If they weren't flying planes into the World Trade Center , the Pentagon or a field in Pennsylvania killing nearly 3,000 people on our own soil, they were rejoicing in the Middle East . No one can dispute the pictures shown from all parts of the Muslim world celebrating on CNN, Fox News, MSNBC and other cable news networks that day. Strangely, the very "moderate" Muslims who's asses you bent
over backwards to kiss in Cairo , Egypt on June 4th were stone cold silent post 9-11. To many Americans, their silence has meant approval for the acts of that day.
And THAT, Mr. Obama, is the "rich heritage" Muslims have here in America .
Oh, I'm sorry, I forgot to mention the Barbary Pirates. They were Muslim.
And now we can add November 5, 2009 - the slaughter of American soldiers at Fort Hood by a Muslim major who is a
doctor and a psychiatrist who was supposed to be counseling soldiers returning from battle in Iraq and Afghanistan .
That, Mr. Obama is the "Muslim heritage" in America.

Is Your Arsenal Up to the Task?

As you sit and marvel at your vast collection of guns, your chest bulging at the immensity of the firepower before you, you may want to squint and consider how it might look to you the moment after the EOTWAWKI. When you consider the staying power versus the firepower, is your arsenal up to the task of digging in or bugging out for the duration?
The debate on the best calibers to own is endless and is mired in personal preferences and prejudices that will leave it eternally unsettled. Still, as you view your collection through the haze of smoke left by mass destruction, you may want to seriously consider which of your guns will see you through the chaos.
During times of scarcity, the quantity of ammo will become more important than the quality of your weapons. The guns you treasure the most may have little value if ammo is not available. Does this mean you will have to completely sacrifice quality and optimum firepower? Not necessarily. It just means you might need to think through your WTSHTF arsenal strategy.
Ammunition shortages are already a reality, especially for odd-ball calibers or surplus marketed guns. Your concern should be whether ammo can be bought or scavenged during times of uncertainty. If you are forced away from your own stockpile, and you run out while you’re on the move, you will want your more popular calibers with you as you are more likely to be able to find ammo replacements.
Your core arsenal should cover your bases for hunting, home defense and long range shooting. It should also address both your survival needs as well as your battle needs. These are different jobs usually requiring different tools. When you can have some guns serve multiple duties, you’re better positioned in the event of ammo shortages and for maneuvering during a bug out.
Your long-range rifle could also serve as your hunting rifle. If you own a 30-06 for hunting, it can also stand in as a competent survival rifle. Add a scope and it can serve, nicely, as a sniper rifle for you. Choosing between your 30-06 and your .308 may be difficult. More enthusiasts will swear by the .308 because the firearms are of higher quality, with some semi-automatic offerings, and it’s considered the best all around gun in its class. Walking into a small town hardware store, you’re more likely to find 30-06 rounds, so that may be the most important consideration when you need to find more ammo quickly.
You won’t find too many arguments about the 12 gauge shotgun as your primary home defense weapon. It is, by far, the most widely available and it offers the greatest amount of flexibility for ammo choice. The choice for a handgun usually comes down to a .357 magnum—again, for ammo availability and its stopping power.
A .22 rim fire rifle will come in handy as the ammo is the most widely available. There is a lot of security in being able to buy ammo in bricks of 500 that can be easily carried. A .22 rifle is somewhat limiting in its loading capacity; however, there are some pretty nice conversion kits that can turn your .22LR fire into a semi-automatic battle-fire weapon using an AR15 or an M16. The kits are relatively cheap and it can greatly improve your overall firepower using inexpensive .22LR ammo.
The bottom line is that, while you don’t need to ignore your favorite guns, if you really want to be prepared for anything, you will want to make sure that the guns you have chambered are the ones with cartridges and ammo that you know will be there for you.

One sunny day in January, 2013
The Marine looked at the man and said, "Sir, Mr. Obama is no longer president and no longer resides here."

The following day, the same man approached the White House and said to the same Marine, "I would like to go in and meet with President Obama."

The Marine, understandably agitated at this point, looked at the man and said, "Sir, this is the third day in a row you have been here asking to speak to Mr. Obama. I've told you already that Mr. Obama is no longer the president and no longer resides here. Don't you understand?"
The old man looked at the Marine and said, "Oh, I understand. I just love hearing it."
The Marine snapped to attention, saluted, and said, "See you tomorrow, Sir."

A friend recently received this letter of appreciation from Michelle Obama – back in Washington for a day or two between family vacations. He was so touched by it that he asked me to share it with you...
Dear Tax Paying Citizen,
For only the second time in my adult life, I am not ashamed of my country. I want to thank the hard-working American people for paying $242, 000, plus additional expenses, for my vacation in Spain . My daughter, Sasha, several long-time family friends, my personal staff, and various guests had a wonderful time. Honestly, you just haven't lived until you have stayed in a $2,500.00 per night suite at a 5-Star luxury hotel. We booked only 70 rooms for our friends, staff, and family. Thank you, also, for the use of Air Force 2 and the 70 Secret Service personnel who tagged along to be sure that we were safe and cared for at all times.
Air Force 2 used only 47,500 gallons of jet fuel for this trip, and carbon emissions were a mere 1,031 tons of CO2. It costs only $11,500 per hour to operate Air Force 2 (and each additional plane for the other members of our party group). These are only rough estimates, but they are close (who's counting?). That's quite a carbon footprint as my good friend, Al Gore, would say, so we must ask the American citizens to drive smaller, more fuel-efficient cars and drive less, too, so that we can lessen our combined carbon footprint.
I know that times are hard and that millions of you are struggling to put food on the table and trying to make ends meet. I do appreciate your sacrifice and do hope you find work soon. I was really exhausted after Barack took our family on a luxury vacation in Maine a few weeks ago. I just had to get away for a few days. Will write more from Martha's Vineyard , where we will spend our sixth vacation this year with more of our family and friends.

Higher Taxes in 2011
Please note this article was written by the senior tax editor of the Kiplinger Letters. You may have information that differs so just consider this as information that may impact you.
In just six months, on January 1, 2011, the largest tax hikes in the history of America will take effect.
They will hit families and small businesses in three great waves.
On January 1, 2011, here's what happens....
First Wave:
Expiration of 2001 and 2003 Tax Relief
In 2001 and 2003, the GOP Congress enacted several tax cuts for investors, small business owners, and families.
These will all expire on January 1, 2011.
Personal income tax rates will rise.
The top income tax rate will rise from 35 to 39.6 percent (this is also the rate at which two-thirds of small business profits are taxed).
The lowest rate will rise from 10 to 15 percent.
All the rates in between will also rise.
Itemized deductions and personal exemptions will again phase out, which has the same mathematical effect as highermarginal tax rates.
The full list of marginal rate hikes is below:
The 10% bracket rises to an expanded 15%
The 25% bracket rises to 28%
The 28% bracket rises to 31%
The 33% bracket rises to 36%
The 35% bracket rises to 39.6%
Higher taxes on marriage and family.
The "marriage penalty" (narrower tax brackets for married couples) will return from the first dollar of income.
The child tax credit will be cut in half from $1000 to $500 per child.
The standard deduction will no longer be doubled for married couples relative to the single level.
The dependent care and adoption tax credits will be cut
The return of the Death Tax.
This year only, there is no death tax. (It?s a quirk!) For those dying on or after January 1, 2011, there is a 55 percent
top death tax rate on estates over $1 million. A person leaving behind two homes, a business, a retirement account, could easily pass along a death tax bill to their loved ones. Think of the farmers who don?t make much money, but their land, which they purchased years ago with after-tax dollars, is now worth a lot of money. Their children will have to sell the farm, which may be their livelihood, just to pay the estate tax if they don?t have the cash sitting around to pay the tax. Think about your own family?s assets. Maybe your family owns real estate, or a business that doesn?t make much money, but the building and equipment are worth $1 million. Upon their death, you can inherit the $1 million business tax free, but if they own a home, stock, cash worth $500K on top of the $1 million business, then you will owe the government $275,000 cash! That?s 55% of the value of the assets over $1 million! Do you have that kind of cash sitting around waiting to pay the estate tax?
Higher tax rates on savers and investors.
The capital gains tax will rise from 15 percent this year to 20 percent in 2011.
The dividends tax will rise from 15 percent this year to 39.6 percent in 2011.
These rates will rise another 3.8 percent in 2013.
Second Wave:
Obamacare
There are over twenty new or higher taxes in Obamacare. Several will first go into effect on January 1, 2011. They include:
The "Medicine Cabinet Tax"
Thanks to Obamacare, Americans will no longer be able to use health savings account (HSA), flexible spending account (FSA), or health reimbursement (HRA) pre-tax dollars to purchase non-prescription, over-the-counter medicines (except insulin).
The "Special Needs Kids Tax"
This provision of Obamacare imposes a cap on flexible spending accounts (FSAs) of $2500 (Currently, there is no federal government limit). There is one group of FSA owners for whom this new cap will be particularly cruel and onerous: parents of special needs children.
There are thousands of families with special needs children in the United States , and many of them use FSAs to pay for special needs education.
Tuition rates at one leading school that teaches special needs children in Washington , D.C. ( National Child Research Center ) can easily exceed $14,000 per year.
Under tax rules, FSA dollars can not be used to pay for this type of special needs education.
The HSA (Health Savings Account) Withdrawal Tax Hike.
This provision of Obamacare increases the additional tax on non-medical early withdrawals from an HSA from 10 to 20 percent, disadvantaging them relative to IRAsand other tax-advantaged accounts, which remain at 10 percent.
Third Wave:
The Alternative Minimum Tax (AMT) and Employer Tax Hikes
When Americans prepare to file their tax returns in January of 2011, they'll be in for a nasty surprise-the AMT won't be held harmless, and many tax relief provisions will have expired.
The major items include:
The AMT will ensnare over 28 million families, up from 4 million last year.
According to the left-leaning Tax Policy Center , Congress' failure to index the AMT will lead to an explosion of AMT taxpaying families-rising from 4 million last year to 28.5 million. These families will have to calculate their tax burdens twice, and pay taxes at the higher level. The AMT was created in 1969 to ensnare a handful of taxpayers.
Small business expensing will be slashed and 50% expensing will disappear.
Small businesses can normally expense (rather than slowly-deduct, or "depreciate") equipment purchases up to $250,000.
This will be cut all the way down to $25,000. Larger businesses can currently expense half of their purchases of equipment.
In January of 2011, all of it will have to be "depreciated."
Taxes will be raised on all types of businesses.
There are literally scores of tax hikes on business that will take place. The biggest is the loss of the "research and experimentation tax credit," but there are many, many others. Combining high marginal tax rates with the loss of this tax relief will cost jobs.
Tax Benefits for Education and Teaching Reduced.
The deduction for tuition and fees will not be available.
Tax credits for education will be limited.
Teachers will no longer be able to deduct classroom expenses.
Coverdell Education Savings Accounts will be cut.
Employer-provided educational assistance is curtailed.
The student loan interest deduction will be disallowed for hundreds of thousands of families.
Charitable Contributions from IRAs no longer allowed.
Under current law, a retired person with an IRA can contribute up to $100,000 per year directly to a charity from their IRA.
This contribution also counts toward an annual "required minimum distribution." This ability will no longer be there.

And worse yet?
Now, your insurance will be INCOME on your W2's!
One of the surprises we'll find come next year, is what follows - - a little "surprise" that 99% of us had no idea was included in the "new and improved" healthcare legislation . . . the dupes, er, dopes, who backed this administration will be astonished!
Starting in 2011, (next year folks), your W-2 tax form sent by your employer will be increased to show the value of whatever health insurance you are given by the company. It does not matter if that's a private concern or governmental body of some sort.
If you're retired? So what... your gross will go up by the amount of insurance you get.
You will be required to pay taxes on a large sum of money that you have never seen. Take your tax form you just finished and see what $15,000 or $20,000 additional gross does to your tax debt. That's what you'll pay next year.
For many, it also puts you into a new higher bracket so it's even worse.
This is how the government is going to buy insurance for the15% that don't have insurance and it's only part of the tax increases.

For Those Who Don't Know What Real Torture Is

I got shot down over N Vietnam in 1967, a Squadron. Commander.
After I returned in 1973...I published 2 books that dealt a lot
with "real torture" in Hanoi . Our make- believe president is
branding our country as a bunch of torturers when he has
no idea what torture is.
As for me, I put thru a mock execution because I would not respond...
pistol whipped on the head....same event.. Couple of days later...
hung by my feet all day. I escaped and a couple of weeks later, I got
shot and recaptured. Shot was OK...what happened afterwards was not.
They marched me to Vinh...put me in the rope trick, trick...almost
pulled my arms out of the sockets. Beat me on the head with a
little wooden rod until my eyes were swelled shut, and my unshot,
unbroken hand a pulp.
Next day hung me by the arms...rebroke my right wrist...wiped
out the nerves in my arms that control the hands....rolled my fingers
up into a ball. Only left the slightest movement of my L forefinger.
So I started answering with some incredible lies.
Sent me to Hanoi strapped to a barrel of gas in the back of a truck.
Hanoi..on my knees....rope trick again. Beaten by a big fool.
Into leg irons on a bed in Heartbreak Hotel.
Much kneeling--hands up at Zoo.
Really bad beating for refusing to condemn Lyndon Johnson.
Several more kneeling events. I could see my knee bone thru
kneeling holes.
There was an escape from the annex to the Zoo. I was the Senior
Officer of a large building because of escape...they started a mass
torture of all commanders.
I think it was July 7, 1969...they started beating me with a car fanbelt.
In first 2 days I took over 300 strokes...then stopped counting
because I never thought I would live thru it.
They continued day-night torture to get me to confess to a non-existent
part in the escape. This went on for at least 3 days. On my knees...
fan belting...cut open my scrotum with fan belt stroke. opened up
both knee holes again. My fanny looked like hamburger...I could not
lie on my back.
They tortured me into admitting that I was in on the escape...and
that my 2 room-mates knew about it.
The next day I denied the lie.
They commenced torturing me again with 3- 6- or 9 strokes of
the fan belt every day from about July 11 or 12th..to 14 October
1969. I continued to refuse to lie about my roommates again.
Now, the point of this is that our make-believe
president has declared to the world that we (U.S..) are a bunch of
torturers...Thus it will be OK to torture us next time when they
catch us...because that is what the U.S. does.
Our make-believe president is a know nothing fool who thinks
that pouring a little water on some one's face, or hanging a pair of
women's pants over an Arabs head is TORTURE.. He is a meathead.
I just talked to MOH holder Leo Thorsness, who was also in my squadron,
in jail...as was John McCain...and we agree that McCain does
not speak for the POW group when he claims that Al Gharib was
torture...or that "water boarding" is torture.
Our president and those fools around him who keep bad mouthing
our great country are a disgrace to the United States . Please pass
this info on to Sean Hannity. He is free to use it to point out the
stupidity of the claims that water boarding...which has no after
effect...is torture.
If it got the Arab to cough up the story about how he planned the
attack on the twin towers in NYC ....
hurrah for the guy who poured the water.

As posted in comments on Greta's article referencing the MOVEON ad about Sarah Palin.
The last 45 of my 66 years I've spent in a commercial fishing town in Alaska . I understand Alaska politics but never understood national politics well until this last year. Here's the breaking point: Neither side of the Palin controversy gets it. It's not about persona, style, rhetoric, it's about doing things. Even Palin supporters never mention the things that I'm about to mention here.
1. Democrats forget when Palin was the Darling of the Democrats, because as soon as Palin took the Governor's office away from a fellow Republican and tough SOB, Frank Murkowski, she tore into the Republican's "Corrupt Bastards Club" (CBC) and sent them packing. Many of them are now residing in State housing and wearing orange jump suits The Democrats reacted by skipping around the yard, throwing confetti and singing, "la la la la" (well, you know how they are). Name another governor in this country that has ever done anything similar.
2. Now with the CBC gone, there were fewer Alaskan politicians to protect the huge, giant oil companies here. So she constructed and enacted a new system of splitting the oil profits called "ACES." Exxon (the biggest corporation in the world) protested and Sarah told them, "don't let the door hit you in the stern on your way out." They stayed, and Alaska residents went from being merely wealthy to being filthy rich. Of course, the other huge international oil companies meekly fell in line. Again, give me the name of any other governor in the country that has done anything similar.
3. The other thing she did when she walked into the governor's office is she got the list of State requests for federal funding for projects, known as "pork." She went through the list, took 85% of the m and placed them in the "when-hell-freezes-over" stack. She let locals know that if we need something built, we'll pay for it ourselves. Maybe she figured she could use the money she got from selling the previous governor's jet because it was extravagant.
Maybe she could use the money she saved by dismissing the governor's cook (remarking that she could cook for her own family), giving back the State vehicle issued to her, maintaining that she already had a car, and dismissing her State provided security force (never mentioning - I imagine - that she's packing heat herself). I'm still waiting to hear the names of those other governors.
4. Now, even with her much-ridiculed "gosh and golly" mannerism, she also managed to put together a totally new approach to getting a natural gas pipeline built which will be the biggest private construction project in the history of North America. No one else could do it although they tried. If that doesn't impress you, then you're trying too hard to be unimpressed while watching her do things like this while baking up a batch of brownies with her other hand.
5. For 30 years, Exxon held a lease to do exploratory drilling at a place called Point Thompson. They made excuses the entire time why they couldn't start drilling. In truth they were holding it like an investment. No governor for 30 years could make them get started. Then, she told them she was revoking their lease and kicking them out. They protested and threatened court action. She shrugged and reminded them that she knew the way to the court house. Alaska won again.
6. President Obama wants the nation to be on 25% renewable resources for electricity by 2025. Sarah went to the legislature and submitted her plan for Alaska to be at 50% renewable by 2025. We are already at 25%. I can give you more specifics about things done, as opposed to style and persona. Everybody wants to be cool, sound cool, look cool. But that's just a cover-up. I'm still waiting to hear from liberals the names of other governors who can match what mine has done in two and a half years. I won't be holding my breath.
By the way, she was content to return to AK after the national election and go to work, but the haters wouldn't let her. Now these adolescent screechers are obviously not scuba divers. And no one ever told them what happens when you continually jab and pester a barracuda. Without warning, it will spin around and tear your face off. Shoulda known better.
You have just read the truth about Sarah Palin that sends the media, along with the democrat party, into a wild uncontrolled frenzy to discredit her. I guess they are only interested in skirt chasers, dishonesty, immoral people, liars, womanizers, murderers, and bitter ex-presidents' wives.

Crime victim persecuted for being gun owner

It used to be in this country that if you were arrested for a crime you were presumed innocent until trial. Now if you are a crime victim you may be perceived as a criminal if you are a gun owner. After reading an article about a burglary in the Land of Lincoln, my blood went to a slow boil.
In the wee hours of an August morning, Rockford (IL) police were called by the victim's neighbors to report a burglary. What the police found was the disorganized and cluttered home of a gun owner. The burglar had fled, but the police were surprised to find a collection of about three hundred firearms. The 67 year-old homeowner was out of town. Research by police showed he is a legal FOID cardholder in Illinois and the guns apparently were registered. Nevertheless the police proceeded to stack his firearms outside his home and then take the guns into custody. I have to ask, since when is the property of the victim confiscated as suspect?
The comments from the neighbors were equally disturbing to me. Coley Woods who lives across the street said, "Even if he's a registered gun owner or not, that just seems like its too many rifles." Oh really! Says who? Since when is there a set number on what any American can own? It used to be a free country, Has that changed?
"It's just un-real to see this many guns involved a regular residential neighborhood," says concerned resident McArthur Tennin."
From the article:
"At the current time we're taking the firearms for safe keeping as evidence until we can further investigate this," says Deputy Chief Lindmark.
Neighbors say even though the weapons may be legal, they still pose a security threat to their neighborhood.
The story concludes by noting that, as of late Wednesday afternoon, "police haven't charged the homeowner."
Charged with what? Gun ownership? That is appalling!
I find it disturbing that there is an automatic assumption that something is wrong because someone owns firearms. The fact that someone has a large collection suggests nothing more to me than a hobby or investment. Are we concerned if we find a large collection of baseball cards or stamps? No, of course not. But because of the "culture of sheep" mindset drummed into so many people in this country, there is often an automatic assumption by some that something is fishy if you own guns. The comment that the firearms being in the neighborhood is some sort of security threat is ludicrous and ignorant. I have little patience with such thinking. I note that nowhere in the story do any of the neighbors suggest any issues or problems with their gun owning neighbor. Yet now he is a "security threat."
The events in this story happened in Illinois, a state that has produced anti-gun politicians like Mayor Richard Daley and President Barack Obama, and still lives in the dark ages of denying their citizens any form of law that allows the carrying of arms for defense. So I suppose I should not be surprised by the anti-gun bigotry exhibited. I can only pray things improve for the citizens of Illinois. But it also reminds us that it is up to all gun owners to do our part to educate the public on the fact that our hobby of gun collecting is as natural as collecting sports memorabilia, coins, tea pots or any other hobby pursued by other law abiding Americans. We gun owners are not a threat to anyone except to politicians who wish to ban our guns and that threat is only carried out at the ballot box.
Make no mistake, friends, we may have the Heller and McDonald decisions behind us, but those who wage war on gun ownership are not deterred or going away. They are as determined as ever to take your guns and vilify you in the process. Join the fight to protect your gun rights today.

Investigative report proves failure of Chicago's gun control policies

The Chicago Sun-Times is running an investigative report on the 59 hours of violence that took place over an unforgettable April weekend in 2008. When the dust settled, 40 Chicagoans were added to the countless victims of the unrelenting violence that has long plagued the city. While Mayor Richard Daley blames guns, and gun dealers, for his inability to stop the carnage, The Sun-Times research shows that an ineffective crime prevention policy is more likely to blame.
In 2009, the vaunted Chicago Police Department, which Mayor Daley claims is among the best in the world, cleared only 18% of non-fatal shootings.
That means 1,740 non-fatal shootings went unsolved and left the perpetrator free to attack again. Such a shockingly low number should put in perspective how badly Mayor Daley has performed in his quest to rid Chicago of violent crime.
By admitting that the police haven't been successful in prosecuting those responsible for turning Chicago into one of the most violent places in America, Daley is admitting he has failed as well - something nobody expects the Mayor to do anytime soon. Instead, he can point the finger elsewhere and use the bully pulpit of the mayoral office as a tool to deflect blame.
Criminals are thrilled when responsibility for their actions is placed elsewhere. After all, if Mayor Daley is spending the city's resources to destroy gun rights, he isn't spending them to put them in prison.
Few can dispute that criminals are thriving in Chicago. They do because while Mayor Daley is spending precious city resources on taking gun companies to court, he isn't spending them to help the police crack down on crime. Chicagoans can only wonder how many police officers and anti-crime initiatives could have been paid for with the millions in legal fees Daley wasted in the quest to destroy private gun ownership.
During the same time period where nearly 1,740 non-fatal shootings went unpunished Mayor Daley supported putting an elderly man in jail for using a non-registered gun in self-defense. The resident in question was not only forced to shoot his attacker, he was then vilified as a criminal by Mayor Daley's spin doctors. Such an act is devoid of any semblance of human decency or compassion.
The Sun-Times report also pointed out that even though the Chicago PD claimed an 18% success rate in solving non-fatal shootings, very few ended with a conviction. By The Sun-Times' estimates, nearly 90% of the crimes in question went unpunished.
Considering all the facts, there is a pretty good chance the elderly man probably shot one of the criminals Chicago P.D. failed to put in jail for previous crimes.
In most other cities in America such a dismal performance in stopping crime would lead to a one-way ticket out of office. But, like New York Mayor Michael Bloomberg, Cleveland Mayor Frank Jackson and Boston Mayor Thomas Menino, Daley has done a great job of deflecting blame onto guns.
In contrast, pro-gun advocates accept that only a criminal is to blame for committing a crime.
But there are mitigating factors that can have a profound effect on crime rates. At the top of that list is leaving criminals on the street after they commit unspeakable crimes. When a criminal commits a heinous crime and it goes unpunished, it not only adds to crime statistics but also instills confidence for the next attack.
The logic is really quite simple to follow: if a criminal is arrested, prosecuted, convicted and sent to prison for a violent crime it is impossible for that same criminal to prey on law abiding citizens while incarcerated.
When a criminal goes unpunished, just leaving a violent thug on the street isn't the only damage to public order. In places like Chicago, the victims of violent crime are victimized again when they testify in court only to watch their attacker go free. When that happens it does immeasurable damage since it discourages the next witness from doing the right thing.
The quickest way to turn around a neighborhood is for the citizens to fight back against crime. By testifying against the criminal element, the law abiding can enhance their power by augmenting it with the power of the criminal justice system. That option is off the table in Chicago because the criminal justice system is broken.
By letting the police administration hide behind the excuse that guns are to blame for crime, Mayor Daley also undermines the hard work and sacrifice of cops on the street. Not only do the citizens of Chicago deserve better from the Mayor and Police Department leadership, but so do the rank and file officers who risks their lives by trying to enforce the law in a near war zone.
Until Daley changes or leaves office, the people of Chicago will live with the fear of being the next victim of the unchecked crime so prevalent in their hometown. Granted, there are neighborhoods in Chicago where people don't live under the constant threat of being victimized.
But, that is the exception and is only available to those at the higher socio-economic levels.
The only other exception is Mayor Daley, who hides behind armed guards, has police patrols around his house, and has the peace of mind that comes with being one of the best-protected people in America.
In his mind, the guns in the hands of his own bodyguards are not evil. But the gun in the hands of a scared 70 year-old homeowner who is trying to defend his wife is the real cause of violent crime in Chicago.

As 145 soldiers returning from Iraq and Afghanistan walked through the double doors in Terminal D at DFW Airport last week for two weeks of R&R, they were greeted not only by their families, but by former president George Bush and his wife Laura.
AFA's long-time friend, Bert Brady, who helps coordinate the welcome home project to our troops coming home for furlough at Dallas Fort Worth airport sent us an amazing video of President Bush welcoming the troops.
It is refreshing to see how pro-American and patriotic our former Commander-in-Chief is.

Brady said about 40 people, among them retirees and veterans, show up almost daily to help welcome home soldiers with ovations as they depart customs and enter the main terminal. More than 750,000 service members have been welcomed as part of the program, he said, and some purposely ask to reroute their return to the U.S. so they can come through DFW.

What to do when.. Pulled Over By A Cop While Carrying Cconcealed weapons
..My goal here is to provide food for thought when dealing with a police encounter on the street or in your vehicle, while you are armed....

I am a cop.
I stop you for a violation of motor vehicle code or law.
You have a weapon.
You have a concealed weapons permit.
What happens now?
I am writing this article as a cop. I am and have been that armed citizen, but that is not what I want to focus on. I am writing this article as a guide to dealing with us cops. Now, everyone has a story about cops. A large majority of those stories may not be what one could describe as "the most wonderful and joyous occasion in recent memory".
Realizing that we are always judged as a group, I try not to be "one of those cops". I have a background in the Marine Corps and grew up shooting and hunting from my earliest memories. My part time job (most cops have some other gig) is working in a local gun shop selling firearms.
I do not question the armed citizen's reasons behind carrying a gun. I understand and promote the concept of an armed and educated citizenry. There are differences in how you and I carry and employ weapons and how we may be involved in a deadly force encounter, but that isn't what I want to focus on either.
My goal here is to provide food for thought when dealing with a police encounter on the street or in your vehicle, while you are armed. I want to do this from my prospective as it may help you to understand it better. Sometimes in order to see things clearly, we have to see it from the reverse angle.
Where I work and live, in Michigan, folks who have a concealed pistol license are required to inform the officer stopping them that they have a weapon with/on them. They can be subject to a civil infraction fine if they do not disclose this information. When not carrying the weapon, they need not do this.
I realize that other states may not require this disclosure to be made. Some people may say that it is none of my business whether or not you have your weapon on you or in your car. To a certain extent, I can understand this. It seems intrusive when you are stopped and detained on a traffic offense. It certainly seems intrusive when you get a ticket right?
My question is why not tell the officer? What do you have to lose by telling me that you have your weapon on you?
Are you lawfully carrying your weapon? Yes.
Is that the reason I stopped you? No.
What are the ramifications of the officer knowing that you have your weapon on you (lawfully)? Well, I have heard many stories about cops doing things such as taking possession of the weapon during the course of the traffic stop. I have heard of officers who may instruct the weapon to be placed in a visible spot in the vehicle until the stop is concluded.
I have heard all sorts of stories about the cops that don't even know how to unload a different weapon than the one that they carry. I do not do any of these things, and I would not recommend these practices to other officers.
Truth be told, I very rarely come into contact with concealed pistol licensees in general. Why? CCW people just don't break the law that much. Upon occasion, I have stopped those with weapons permits in my jurisdiction.
My concerns when approaching the vehicle are primarily the occupants of the car. Traffic is always a secondary concern as is the rest of the environment of the stop, but that is my problem, not necessarily yours.
What I look for may be the positioning of the hands. What I like to see is both hands visible. A good place for the driver is on the wheel, 10 and 2 if you will. It is easy for me to see this as I approach from either side of the vehicle.
Passengers in a vehicle who may be armed can place their hands in their laps if possible. This may seem somewhat remedial, but you would not believe how many people start digging in their vehicle like they were mining for gold.
Picture yourself in my situation; just clearing an intensive domestic assault call or stand off with a suicidal subject and my first traffic stop afterwards is searching frantically around the car for god knows what.
1. Don't dig around...
Don't dig around looking for your paperwork, that French fry you dropped when the lights came on or your kid's pacifier. I do not enjoy putting you at gunpoint. It is stressful for both of us. We can avoid this problem by staying put and keep our hands comfortably visible.
I say 'stay put'; I mean stay in the vehicle. I realize that some jurisdictions may ask you to step from the vehicle. Do so when asked. Again, this may seem remedial, but someone who exits a car, without being asked, on a traffic stop gives an impression that he is either going to do us harm or run from us.
2. Eye Contact...
Make eye contact with the officer. Nothing says "I'm crazy" or "I have something to hide" like the 1000 yard stare down the roadway. This behavior has led to several searches, arrests, and some altercations upon further investigation.
3. Smile!
Like Mr. Rourke of Fantasy Island was fond of saying "Smiles everybody, smiles!" Make eye contact and smile. It will let the officer know that he can communicate with you.
4. Keep it hidden...
If you have the gun lying on the seat next to you or in plain sight, plan on having that muzzle related talk mentioned earlier. We know that an action beats a reaction almost every time. A visible weapon is an accessible weapon to a suspect. Concealed Carry means CONCEALED. Unless regulated by statute, I do not want to see your weapon. It would seem obvious, but even if you know this officer, this is no time to play a prank or joke.
I don't come to your work area and play practical jokes on you, do not do it to me. Your motives may be playful but the results could be devastating to you and the officer. I have had people do this before. For the life of me I do not know why and the resulting opinion is that the officer is a jerk for not getting the joke.
5. Take it easy...
No sudden movements to see if he is paying attention. No furtive movements to joke around.This may not be a potential lethal force encounter to you. It is to us, all of the time.
6. When do you tell him?
The time to inform the officer is upon his greeting. Do not say "I have a gun". Never utter this phrase. Never utter any variation of this phrase. There is no good that can come from that phrase when said to an officer. All we hear is "have a gun" and the rest is implied. The highway can be a noisy place and we may not hear everything you said.
7. How do you tell him?
Greet him and tell him you have a concealed weapons permit and the weapon is on your person/in the car.
8. Hand your permit...
Hand him your permit with your operator's license and any required paperwork like your registration and proof of insurance. The officer will likely ask where the weapon is. Tell him. There is no reason not to as long as you are abiding by local and state laws. Do not reach for the weapon unless asked to do so. Most officers, me included will not tell you to do this.
9. Then what?
The officer will most likely tell you very specifically to stay put or give further instructions based on training, experience, and departmental guidelines or operating procedures. Bear in mind that some agencies may have procedures and some may not. If you feel that action was taken that was unnecessary or infringed on your rights, check into the existence of a guideline or policy in the department involved.
If you are polite and proper, you may just even get out of a citation. You may not agree with the citation. This is not the time for that discussion. There are hearings for that. Even if you get a citation, thank the officer and be on your way. Take him to court to air your grievances.
Remember that you are a representative of all the concealed weapons permit holders out there, just as we are all the same cops. You have a responsibility to your fellow armed citizens to act in a manner that reflects well on your peers.
A bad incident involving a permit holder will resound with all the power that the media can muster. Your good behavior will not make headlines on a regular basis what so ever, but you may save the day once in your life.
In that respect, we are a lot alike.

THE TEA PARTY RESCUES AMERICA

For a decade, the left owned the streets. Subsidized by George Soros and energized by the Clinton impeachment in the 90s and the Iraq War since, it dominated the Internet and grass roots campaigning. Michael Moore's movies - however misguided - enthused their ranks and catalyzed their efforts. ACORN worked to commit massive voter fraud in the guise of stimulating voter turnout and the New Black Panthers worked to intimidate those with whom they disagreed. President Barack Obama was the result.
Now, finally, conservatives are answering with their own grass roots efforts in the Tea Party movement. Tea Party activists are bringing the battle to stop big government spending and taxes to the streets and parks of America.
And its working! The Tea Party movement, working closely with Americans for Prosperity (AFP), mobilized people against the Obamacare proposal and, in the end, will cost the Democrats their Congressional majorities - a fitting price for defying the will of the people.
Democrats are so threatened that they are demonizing the Tea Party as eccentric, extreme and racist. Speaker Pelosi compared them to the Nazis. These are the cries of those about to lose an election - big time!
Now a new film, The Tea Party Movie, shows the anatomy of the group and explains its motivations. With almost no funding or paid staff and all decisions made at the local level, the Tea Party people are reshaping American politics. A bottom-up movement, they are restoring values to our politics.

The Tea Party is not only electing Republicans, it is cleansing them. Their victories in intra-party contests in Utah, Colorado, Nevada, and South Carolina shows that they are no happier with big spending Republicans than with Democrats of a similar persuasion. Many worried that the Tea Party would be a third party movement, splitting the vote and electing the Democrats. No way. Instead, they are winning their primaries and purifying the Party.

Packing for a Disaster – Pack Like You’re Leaving Today

Careful thought and preparation needs to go into any evacuation plan. Among the most important aspects of a sound plan is your supply checklist. When disaster strikes, you won’t have time to gather the essential supplies and provisions, so it’s not enough just to make a list. Everything you will need, with consideration for all of the contingencies and alternative modes of transportation (vehicle, biking, walking) needs to be ready to go at a moment’s notice.
One of the most important pieces of equipment to consider is your bug-out bag. Duffle bags and regular backpacks will fall short of your needs if you’re forced to go by foot or bike. A full-frame hiking pack is the recommended type because of its sturdiness and its multiple pockets and features.
Your bug-out bag needs to be chosen based on its features as well as its fit to your body. Carrying a heavy bag for long distances can be debilitating after awhile unless it is physiologically compatible with your body size and type. It’s important that your hips bear the bulk of the weight of a fully loaded bag so that your back is spared unnecessary stress.
It is also recommended that you choose your pack only after thoroughly trying different sizes. It’s best to load them fully when trying them on so you can get an accurate measure, and know how the belts will feel when the pack is attached to your body.
Even though you may be bugging out in your vehicle, it is recommended that you have with you a bike or pedestrian cargo carrier, or some way of towing your supplies long distance should you be forced to walk or bike. Even a wheel barrow or jogging stroller will enable you to tow a fair amount of supplies.
What to Pack
For the most part, the situation will dictate what you can and should take. There is no way to know ahead of time the nature or extent of the disaster you will face. It is difficult, therefore, to determine whether you should prepare your pack for a one-day hike to a shelter or a one-week excursion to get to a safe retreat. A safe bet would be to have a three-tiered packing plan that includes contingencies for bug out by vehicle, bicycle and walking.
Everything you might need for any situation ought to be organized in one place so that you can make the necessary packing adjustments within a very short period of time. Bugging out due to an anticipated weather event may allow you a little more time to adjust your packing than if your area comes under in a sudden emergency. Be prepared for either situation.
The contents of your bug-out bag are of great importance because it could be used in any contingency. I recommend your ‘stand by’ preparation be for a 3-day trip. If, after you evaluate the situation, you find that you need more or less, adjustments can be made quickly.
The core essentials for your bug-out bag should include:
■A water filter
■A complete backpack camping kit including a butane stove
■Plastic garbage bags
■6 high calorie MRE-type meals
■Battery powered emergency radio
■Solar battery charger
■A backpacker’s tool kit including a multi-purpose tool
■Extra thermal underwear and wool linings for shoes and gloves
■Emergency blankets
■Sleeping bag and ground cover
■A poncho
■Extra pair of hiking boots or shoes
■A complete medical kit
■Insect repellent
For biking, add the following:
■2 extra tubes per bike
■Bike tool kit
Essential supplies for your vehicle (stored within close proximity for quick loading):
■1 to 2 weeks of food
■Clothes
■Document safe, along with a water proof satchel that can carry the documents if walking becomes necessary
■7 to 10 gallons of gas
■12 to 16 gallons of water
■Full set of cooking gear, including propane stove
■Extra propane
■A cargo carrier that can be used when biking or walking if the vehicle breaks down.
This three-tiered approach to packing for a bug out covers all of your contingencies while providing the most flexibility for situational adjustments. Should a quick evacuation be necessary, it would take less than 20 minutes to load the car. And, as always, I recommend that you practice! OIL - you better sit down
Here's an interesting read, important and verifiable information :
About 6 months ago, the writer was watching a news program on oil and
one of the Forbes Bros. was the guest. The host said to Forbes, "I am going to
ask you a direct question and I would like a direct answer; how much oil
does the U.S. have in the ground?" Forbes did not miss a beat, he said, "more
than all the Middle East put together." Please read below.
The U. S. Geological Service issued a report in April 2008 that only
scientists and oil men knew was coming, but man was it big. It was a
revised report (hadn't been updated since 1995) on how much oil was in
this area of the western 2/3 of North Dakota, western South Dakota, and

The Bakken is the largest domestic oil discovery since Alaska's Prudhoe
Bay, and has the potential to eliminate all American dependence on foreign
oil. The Energy Information Administration (EIA) estimates it at 503 billion
barrels. Even if just 10% of the oil is recoverable... at $107 a barrel,
we're looking at a resource base worth more than $5..3 trillion.
"When I first briefed legislators on this, you could practically see
their jaws hit the floor. They had no idea.." says Terry Johnson, the Montana
Legislature's financial analyst.
"This sizable find is now the highest-producing onshore oil field found
in the past 56 years," reports The Pittsburgh Post Gazette. It's a
formation known as the Williston Basin, but is more commonly referred to as the
'Bakken.' It stretches from Northern Montana, through North Dakota and
into Canada.. For years, U. S. oil exploration has been considered a dead
end. Even the 'Big Oil' companies gave up searching for major oil wells
decades ago. However, a recent technological breakthrough has opened up
the Bakken's massive reserves.... and we now have access of up to 500
billion barrels. And because this is light, sweet oil, those billions of barrels
will cost Americans just $16 PER BARREL!
That's enough crude to fully fuel the American economy for 2041 years
straight. And if THAT didn't throw you on the floor, then this next one
should - because it's from 2006!

Armed Senior Citizen: Entering and Exiting Your Motor Vehicle Safely Everyday
...One of the places where we need to be especially aware of our surroundings is whenever we are entering and exiting our motor vehicle...

Be aware of your surroundings. One of the places where we need to be especially aware of our surroundings is whenever we are entering and exiting our motor vehicle. In Florida, at least, where there are a lot of senior citizens, crime around vehicles and in parking lots is rampant. Vehicles can be like Venus Fly Traps. Don't be a fly! Be prepared. Every day, senior citizens are attacked (i.e., “mugged”) as they go about their business of entering and exiting their motor vehicles in an unaware state of mind. Criminals are aware of, and take advantage of, this glut of scared and unaware elderly citizens. Opportunistic criminals lie in wait in parking lots, and stake out people's driveways. This means that you need to think about the act of entering and exiting your vehicle as a potential danger situation. Don't allow yourself to get car jacked; the results are not pretty. Carjack victims have a greater than one in two chance of ending up dead or missing!
Let the surprise be the carjacker's, nut ours.
I have an elderly mother who lives in Florida. I know first hand that many seniors feel compelled to limit their lives to avoid becoming crime victims. They often do not venture out of their immediate personal zones of comfort—the one-mile vicinity around their apartment or condominium complex. They avoid going to see a late movie (even if they can't sleep) and sometimes avoid even dining out or even going to the movies at all. This is no way to live! Some scared seniors even live the life of a shut-in. It does not have to be this way!
So, what are some rules for staying safe when you are getting in and out of your motor vehicle? First, never allow yourself to get distracted. Always maintain full awareness of what you are doing and what is going on around you. Have your personal defense tool or tools at the ready.
Stay in “Condition Yellow”—aware and alert. In this way, you are mentally and physically prepared to be approached, but not surprised. You know beforehand what you are going to do if you are in fact approached. This means having your verbal tape loops and automatic psychomotor routines ready to roll. You must have a plan. Having several tools such as those pictured in the photo should be part of your plan.

Status check. Whenever you leave your vehicle make a mental note of its condition. Please be sure to always lock your doors! When you return to the vehicle, note whether there has been any change in its condition.
Whenever you approach your parked vehicle, whether it is in your own driveway or a parking lot, make sure it's in the same condition in which you left it. If it is not, proceed with extreme caution and do not enter! If something doesn't look right, don't ignore your perceptions. Try to figure out what it is that is not right, or just move away from your vehicle immediately and get help.
Carry small loads—even if you have to make multiple trips to your vehicle—keeping at least one arm free for movement. Carry your keys at the ready. As you approach your vehicle, observe it. Check its 360: Look around and under the vehicle. Look into the front and back seats before unlocking the door. When you open your door, keep scanning your 360 degree environment. This is a carjacker's favorite time to rush you. So, make certain that no one is approaching before you begin to get into your vehicle. You must be prepared to deal with a situation. While you are partially compromised as you are getting into your vehicle, you could be rushed by an attacker. Stay alert and keep your attention focused on the area around your vehicle and inside your vehicle as you get in.
As soon as you are safely in your vehicle, lock the doors. Once you are in and the doors are locked, do not dawdle! This is not the time to clean, look for things, or to become distracted talking on your cell phone. Be deliberate. Remember, parking lots and driveways are dangerous places. Violent crimes occur in these places every day.
Use light. Try to park in lighted areas. However, if you cannot, have a powerful flashlight, such as the SureFire shown in the Photo. If it is dark outside, use your flashlight to check out the interior and underside of your vehicle. Such a bright light can serve several useful functions: It can help you locate the presence of an intruder, identify an intruder, and blind the intruder. The particular light shown in the photo can also serve to deliver a sharp knock to the intruder's noggin and buy you time to get away. It can also help you find your keys!
Carry pepper spray. The Spitfire pepper spray shown in the photo can serve to ruin any intruder's day! Again, pepper spray is a less than lethal force option that can buy you needed time to make your exit from the situation. Things to do and not do:
If you are with a companion. Do not let yourself become distracted. Someone (probably you) should be the designated bodyguard. Let everyone enter the vehicle while you stand by the open door and scan your surroundings for threats. When everyone is safely seated inside the vehicle, promptly get in and lock the doors. The point is to be your own bodyguard. Unless we are rich enough to hire professional bodyguards (and even then we shouldn't let down our guard), we have to take full responsibility for our personal safety.
Walk with confidence. Opportunistic criminals and violent criminal actors (as opposed to the criminally insane) look for easy prey. They select “victims” and not “victors”. As such, they search for people who appear weak and vulnerable, and those who are not paying attention. So don't be a victim. As noted defensive firearms trainer and author, John Farnam, likes to say, “Own your magnificence. Walk with confidence. Be deliberate. Do not dawdle. Don't be tentative. Look like you know what you are doing and know where you are going.”
Keep your valuables out of sight. Valuables are “dirt magnets”. Don't attract opportunistic criminals. Keep your valuables out of sight and locked up if possible.
Carry a spare key. This is essential should you lose your keys. If you don't have a spare set and you lose your keys, you will look lost and then you will become a target. Don't let this happen to you.
Avoid conversations and altercations. If at all possible, avoid engrossing distracting conversations and altercations when you are entering and exiting your vehicle. Certainly you become a mark if you are arguing with other passengers in your vehicle. Stay focused and alert. If someone starts up with you, disengage promptly. Have an automatic verbal tape loop ready to help you to disengage. For example, in ascending order of verbal force:
“Sorry sir, I apologize.”
“Sorry sir, I did not mean to offend you. I am sorry.”
“Sorry sir, I cannot help you.”
“Get away from me!”
“Leave now!”
“Get out of here!”
Rattle off the verbal tape loop and then leave. Don't linger. The key is to avoid antagonizing strangers or other drivers. Also, it helps to avoid sporting on your vehicle bumper stickers that draw attention. Learn to live as John Farnam calls the “stealth existence”. It is much better not to be noticed. So, avoid wearing bright provocative clothing. Bright red, orange and yellow vehicles also draw unnecessary attention. Park and travel on main streets and in well lit, populated, areas as much as possible. If you feel you are being followed, drive to the nearest police or fire station, or populated area, and sound your horn for help. Remember, you can learn to use that cane or umbrella as an effective defense tool to discourage an attack, or put distance between yourself and an attacker and buy time to get away.
Additional Dos and Don'ts:
Don't stop for disabled vehicles.
Do not pick up strangers.
If you are rear-ended or struck by another vehicle, stay in your vehicle and call 911. Keep the doors locked. If you sense danger, drive away and head to the nearest police or fire station after calling 911.
Summary: Be your own bodyguard:
Seemingly innocuous driveways and parking lots, as well as curbside parking situations, are crime magnets. Hopefully, we represent the positive pole. However, positive attracts negative. As such, we must be prepared to peel off negative polarities that are attracted to us, or camouflage our positive pole with the outward persona of toughness, invulnerability, confidence, and lack of receptiveness (and maybe even a little negativity). Remember do not dawdle. Be decisive. Go about your business aware and alert, and then promptly leave. Remember to watch and notice if you are being followed. Be your own bodyguard, and remember to carry your own personal guardian.

Is this man truly a genius?
An economics professor at a local college made a statement that he had never failed a single student before, but had recently failed an entire class. That class had insisted that Obama's socialism worked and that no one would be poor and no one would be rich, a great equalizer.
The professor then said, "OK, we will have an experiment in this class on Obama's plan".
All grades would be averaged and everyone would receive the same grade so no one would fail and no one would receive an A....
After the first test, the grades were averaged and everyone got a B. The students who studied hard were upset and the students who studied little were happy. As the second test rolled around, the students who studied little had studied even less and the ones who studied hard decided they wanted a free ride too so they studied little.
The second test average was a D! No one was happy.
When the 3rd test rolled around, the average was an F.
As the tests proceeded, the scores never increased as bickering, blame and name-calling all resulted in hard feelings and no one would study for the benefit of anyone else.
All failed, to their great surprise, and the professor told them that socialism would also ultimately fail because when the reward is great, the effort to succeed is great, but when government takes all the reward away, no one will try or want to succeed.

General Bill Ginn' USAF (ret.) asked Obama to explain WHY he doesn't follow protocol when the National Anthem is played. The General stated to Obama that according to the United States Code, Title 36, Chapter 10, Sec. 171...During rendition of the national anthem, when the flag is displayed, all present (except those in uniform) are expected to stand at attention facing the flag with the right hand over the heart. Or, at the very least, "Stand and Face It".

"As I've said about the flag pin, I don't want to be perceived as taking sides". "There are a lot of people in the world to whom the American flag is a symbol of oppression.." "The anthem itself conveys a war-like message. You know, the bombs bursting in air and all that sort of thing."

Social Security Cards up until the 1980s expressly stated the number and card were not to be used for identification purposes. Since nearly everyone in the United States now has a number, it became convenient to use it anyway and the message was removed.

"Warning: Giving a Statement After a Shooting..."
..The story had a happy ending, but a story four years and tens of thousands of dollars in the making, and not a story the Marshal enjoyed very much....

In 1996, an unhappy consumer attacked the City Marshal of Lancaster, Missouri with a hammer.(1) The Marshal defended himself and later vented his adrenaline to the responding Sheriff stating, “I hope the son-of-a-bitch is dead.” This led to the Marshal’s conviction for involuntary manslaughter and a sentence of seven years in prison.(2) The story had a happy ending, but a story four years and tens of thousands of dollars in the making, and not a story the Marshal enjoyed very much. The Marshal might have avoided the worst part of the story had he not confused his right to remain silent with the right of free speech.
In the movie, Under Pressure, a woman tried to explain the stalking and implied threats of a neighbor. After a disorganized and unconvincing recitation of ambiguous events she lamely concludes, “I’m not a very good story teller.” Most people tell stories badly. In the aftermath of self-defense there can be a giddy stream of consciousness statement which has more to do with the effects of adrenaline than reality. The basic legal advice is “DON’T.”
The first question is, “What is a statement?” In a nation which counts exotic dancing as freedom of speech, a statement is also broadly construed. In 1996, the Missouri Supreme Court ruled that a suspect’s refusal to uncross his legs during questioning could be taken as a statement when later charged with murder.(3) In a separate death penalty case, the court found that the defendant had purchased a used car which sported the bumper sticker, “I’m the person your mother warned you about.” At trial the prosecution argued that the fact he did not remove this bumper sticker revealed something about his character. The Missouri Supreme Court ruled that it was perfectly acceptable for the state to kill this man, in part, because of his failure to remove the bumpersticker.(4) One can imagine the effect of bumper stickers bought in jest such as, “Keep Honking, I’m Reloading.” If this case does not also inspire a re-evaluation of one’s T-shirt collection, nothing will.
There is also the problem of nicknames. As of this writing, a rapper who rejoices in the stage name “C-Murder” is on trial for murder. If I were asked to defend a man named “Murder” or any variation thereof, I would charge more. Massad Ayoob testified in favor of a police officer who had killed a felon nicknamed “Snake.” Captain Ayoob slipped the nickname into his testimony which seems to have had an effect on the jury.
Written statement, a VERY BAD idea!
There is a cynical defense attorney saying: “Anything you say will be misquoted and used against you.” In the movie, My Cousin Vinnie, two, unfortunate Yankees are suspected of murder and during questioning are accused of shooting a clerk. One incredulously asked, “I shot the clerk?” This is taken down and read in court as a confession. Theater audiences laughed, defense attorneys smiled and nodded. There have even been cases where comments by other persons have been attributed to the defendant, and used against him; complete silence is the only bulwark against these mistakes.
The first statement is the 911 call. These calls are recorded and if the call sounds bad for the defendant, it will be played over and over again at trial. In one case, a man cocked his double-action revolver and went after a person who was shooting out windows. When he caught up with the threat he extended his revolver and in the process tripped the light single action trigger pull; arguably an accidental discharge. His 911 call records him saying that he thought he had just shot someone. The 911 operator, trained to keep him on the line and keep him talking, asked why he thought he had shot someone. The man replied, “Lady, I think I’m a pretty good shot.” This callous-sounding statement took accident off the table and the man had to live or die with a self-defense case. This all important introduction to law enforcement must be planned in advance.
The first words out of the caller’s mouth should be the location of the incident. If the battery then dies, or the minutes run out, or some other technological catastrophe occurs the authorities will know that something of interest is at that location, and the caller’s cell phone records can prove that he or she made the call. The next statement is the caller’s name. The core of the 911 call consists of three sentences:
“He tried to kill me.”
“I was never so scared in my life.”
“Send an ambulance.”(5)
The first sentence serves to introduce the roles of the parties, the caller is the victim, the other person the attacker. Being in reasonable fear of life or limb is a prerequisite to acting in self-defense. The phrase “I was never so scared…” is to preclude the prosecutor from claiming that the citizen never said he was scared “until he talked to a lawyer.”(6) The phrase “Send an ambulance” says that the caller does not want anyone to die.
When the police arrive, they will want a more elaborate statement; this should consist only of:
1. He attacked me.
2. I will sign a complaint.
3. There is the evidence.
4. I WANT A LAWYER.
Good Advice.
This restates part of the 911 call and points out critical evidence. One cannot expect the “CSI” team to be called out to pick up every fiber and hair. If a real forensic team routinely conducted the investigations shown on television, its budget would last about a week.
The demand for a lawyer is both the best thing one can do, and a damaging statement. Anyone who is questioned by police has the right to a lawyer; this includes victims. The problem is that the police, and potential jurors, take a demand for a lawyer as evidence of something to hide. To compound the problem, the victim’s decision to remain silent and demand for a lawyer can be used again him or her in court. In the criminal system, one does not have rights, until arrested; it doesn’t have to make sense, it’s just the law. It is a left-handed fortune that people who act in self-defense are routinely arrested. It may be called something else such as “detained” or given the “Alice in Wonderland” explanation “You’re being handcuffed for your own protection.” Whenever a person is not allowed to leave, he is placed under arrest regardless of descriptive terms. If one is arrested, generations of TV shows advise us to remain silent.

If the circumstances are ambivalent, simply state a fear of being sued, and demand a lawyer to protect against frivolous litigation. Bernard Goetz was acquitted of criminal charges in the shooting of four thugs on the subway, but was sued for $43 million and lost. Police are frequently sued by criminals and the explanation is likely to ring a bell.
Self-defense cases bring out the curious, the media in the forefront. Comments to friends will be confused and used against you, comments to family will be mistaken and used against you. Both family and friends can be subpoenaed and forced to testify against you. Comments to the media will be sensationalized and this is never good. The New York City prosecutor’s office had determined not to charge Bernard Goetz, until he made unwise remarks to the news media. At some point a statement must be made. The impression is that the earlier a statement is made, the more reliable it is. In reality, the earlier a statement is made, the less reliable it is. The effects of stress will confuse the statement and even cause temporary amnesia. Inaccuracies in the initial statement will convince authorities that the survivor is both a liar and a murderer. A lawyer must be immediately engaged to organize the statement.
A lawyer is a professional storyteller. He will not tell the client how to lie, he will tell him how to tell the truth, a more complicated process than most imagine. The statement must contain facts which track the elements of self-defense. In the case of defense of home or defense of other persons, there may be other elements as well. Knowledge of the assailant’s reputation for violence would certainly be relevant. The most important element to include is fear. A police statement is no place for macho posturing. One cannot use violence against another person unless in fear of life or limb. The survivor must go over every detail of why he or she was terrified, weak-kneed, pants-pissing afraid. If one does foul one’s pants, a not uncommon event, make sure that goes into the statement. No matter how ineffective a storyteller the survivor might be, the jury is sure to believe that.
